SPECIAL IMPORT MEASURES ACT

Certain drill pipe — Decision

On May 24, 2022, pursuant to paragraph 35(1)(b) of the Special Import Measures Act (SIMA), the Canadian International Trade Tribunal (CITT) determined, with respect to certain drill pipe from China, that the evidence does not disclose a reasonable indication that the dumping and subsidizing of the subject goods have caused injury or retardation or are threatening to cause injury to the domestic industry. Therefore, pursuant to paragraph 35(3)(a) of SIMA, the CITT terminated the preliminary injury inquiry with respect to the subject goods.

Consequently, the Canada Border Services Agency, pursuant to paragraph 35(2)(a) of SIMA, terminated the investigations of dumping and subsidizing in respect of certain drill pipe from China, effective May 25, 2022.

Issues Whether, in determining the value for duty of certain wedding gowns and bridal accessories under section 48 of the Customs Act, the sale for export was between Maggie Sottero (Canada) Ltd. (MSC) and unrelated foreign manufacturers or between Maggie Sottero Designs LLC and Stevara Distribution dba The Bridal Distribution Centre and, in the case of the former, whether MSC was a "purchaser in Canada" within the meaning of section 2.1 of the Value for Duty Regulations; and whether certain costs should be included in the calculation for the adjustment to the price paid or payable for certain wedding gowns and bridal accessories pursuant to subparagraph 48(5)(a)(iii)(D) of the Customs Act.
