SPECIAL IMPORT MEASURES ACT

Certain carbon and alloy steel line pipe — Decisions

On August 28, 2015, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the President of the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidizing in respect of certain carbon and alloy steel line pipe originating in or exported from the People's Republic of China.

The goods in question are usually classified under the following Harmonized System numbers:

The Canadian International Trade Tribunal (Tribunal) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The Tribunal will make a decision within 60 days of the date of initiation. If the Tribunal concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA Web site at www.cbsa-asfc.gc.ca/sima-lmsi or by contacting the SIMA Registry and Disclosure Unit by telephone at 613-948-4605 or by email at simaregistry@cbsa-asfc.gc.ca.

Representations

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping and subsidizing. Written submissions should be forwarded to the Canada Border Services Agency, Trade and Anti-dumping Programs Directorate, SIMA Registry and Disclosure Unit, 100 Metcalfe Street, 11th Floor, Ottawa, Ontario, K1A 0L8. To be given consideration in these investigations, this information should be received by January 11, 2016.

Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission also must be provided.

Issue: Whether the goods in issue are properly classified under tariff item No. 2106.90.94 as other food preparations not elsewhere specified or included containing 50% or more by weight of dairy content, over access commitment, as determined by the President of the Canada Border Services Agency, or should be classified under tariff item No. 2106.90.95 as other food preparations not elsewhere specified or included containing, in the dry state, over 10% by weight of milk solids but less than 50% by weight of dairy content, as claimed by Dealers Ingredients Inc.

Hot-rolled carbon steel plate and high-strength low-alloy steel plate

Notice is hereby given that, on August 10, 2015, pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal determined (Preliminary Injury Inquiry No. PI-2015-001) that there was evidence that disclosed a reasonable indication that the dumping and subsidizing of the above-mentioned goods had caused injury or were threatening to cause injury to the domestic industry.

FINDING

Photovoltaic modules and laminates

Notice is hereby given that, on July 3, 2015, the Canadian International Trade Tribunal found that the dumping and subsidizing of photovoltaic modules and laminates consisting of crystalline silicon photovoltaic cells, including laminates shipped or packaged with other components of photovoltaic modules, and thin-film photovoltaic products produced from amorphous silicon (a-Si), cadmium telluride (CdTe), or copper indium gallium selenide (CIGS) [Inquiry No. NQ-2014-003], originating in or exported from the People's Republic of China, excluding modules, laminates or thin-film products with a power output not exceeding 100 W, and also excluding modules, laminates or thin-film products incorporated into electrical goods where the function of the electrical goods is other than power generation and these electrical goods consume the electricity generated by the photovoltaic product, have not caused injury but are threatening to cause injury to the domestic industry.

Furthermore, the Canadian International Trade Tribunal excluded from its threat of injury finding 195 W monocrystalline photovoltaic modules made of 72 monocrystalline cells, each cell being no more than 5 inches in width and height.

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) issued an order (File No. PR-2015-019) on August 25, 2015, with respect to a complaint filed by Adirondack Information Management Inc., of Ottawa, Ontario, concerning a procurement (Solicitation No. EZ899-160201/A) by the Department of Public Works and Government Services. The solicitation was for project management services.

Pursuant to subsection 30.13(5) of the Canadian International Trade Tribunal Act, the Tribunal has ceased its inquiry into the complaint and terminated all proceedings relating thereto.
