SPECIAL IMPORT MEASURES ACT

Certain steel plate — Decision

On April 17, 2014, the President of the Canada Border Services Agency (CBSA) made a final determination of dumping pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), in respect of certain hot-rolled carbon steel plate and high-strength low-alloy steel plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths, in widths from 24 inches (+/− 610 mm) to 152 inches (+/− 3 860 mm) inclusive, and thicknesses from 0.187 inches (+/− 4.75 mm) up to and including 3.0 inches (76.2 mm) [with all dimensions being plus or minus allowable tolerances contained in the applicable standards], but excluding plate for use in the manufacture of pipe and tube (also known as skelp); plate in coil form, plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate), originating in or exported from the Federative Republic of Brazil, the Kingdom of Denmark, the Republic of Indonesia, the Italian Republic, Japan, and the Republic of Korea.

On the same date, pursuant to paragraph 41(1)(b) of the SIMA, the President of the CBSA terminated the dumping investigation in respect of the above mentioned goods originating in or exported from Chinese Taipei.

The subject goods are usually classified under the following Harmonized System classification numbers:

The Canadian International Trade Tribunal (Tribunal) is continuing its inquiry into the question of injury to the domestic industry and will make a finding by May 20, 2014. Provisional duties will continue to apply until this date on imports of subject goods from these six countries.

If the Tribunal finds that the dumping has caused injury or is threatening to cause injury, future imports of subject goods will be subject to anti-dumping duty equal to the margin of dumping on the goods. In that event, the importer in Canada shall pay all such duties.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping duty.

(ACS), of Toronto, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. 201403094) by the Royal Canadian Mounted Police. The solicitation was for the provision of ethyl alcohol standards.

ACS alleged that the procurement process favoured one potential supplier.

EXPIRY REVIEW OF ORDER

Certain fasteners

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it will, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiate an expiry review (Expiry Review No. RR-2014-001) of its order made on January 6, 2010, in Expiry Review No. RR-2009-001, continuing, with amendment, its findings made on January 7, 2005, in Inquiry No. NQ-2004-005, concerning the dumping of certain carbon steel fasteners originating in or exported from the People's Republic of China and Chinese Taipei and the subsidizing of such products originating in or exported from the People's Republic of China, excluding the products described in Appendix 1 (the subject goods). The order is scheduled to expire on January 5, 2015.

In this expiry review, the Canada Border Services Agency (CBSA) will first conduct investigations to determine whether the expiry of the order in respect of the subject goods is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods. If the CBSA determines that the expiry of the order in respect of any goods is likely to result in the continuation or resumption of dumping and/or subsidizing, the Tribunal will then conduct an expiry review to determine if the continued or resumed dumping and/or subsidizing is likely to result in injury or retardation. The CBSA must provide notice of its determinations within 120 days after receiving notice of the Tribunal's decision to initiate an expiry review, that is, no later than August 21, 2014. The Tribunal will issue its order no later than January 5, 2015, and its statement of reasons no later than January 20, 2015.

Each person or government wishing to participate in this expiry review must file a notice of participation with the Secretary on or before September 3, 2014. Each counsel who intends to represent a party in the expiry review must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before September 3, 2014.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2014-007) from CAE Inc. (CAE), of Montréal, Quebec, concerning a procurement (Solicitation No. W8482-134640/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for the provision of in-service support of the VICTORIA Class Unique Trainers. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on April 22, 2014, to conduct an inquiry into the complaint.

CAE alleges that PWGSC failed to meet its obligations under Article 506(6) of the Agreement on Internal Trade by misinterpreting the terms of the solicitation and misapplying the evaluation criteria to CAE's proposal, as well as under Article 1015(4)(d) of the North American Free Trade Agreement by applying undisclosed criteria that were not included in the solicitation documents.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2014-006) from CGI Information Systems and Management Consultants Inc. (CGI), of Gloucester, Ontario, concerning a procurement (Solicitation No. 2012-SDL-006) by Innovapost Inc. on behalf of the Canada Post Group of Companies (Canada Post). The solicitation is for the provision of data centre services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on April 17, 2014, to conduct an inquiry into the complaint.

CGI alleges that Canada Post failed to meet its obligations under Article 1013(1) of the North American Free Trade Agreement (NAFTA) by applying evaluation criteria that were not completely disclosed in the solicitation documents; under Articles 1015(4)(c) and (d) of NAFTA by departing from the methodology set out in the solicitation documents; and under Article 1015(6) of NAFTA by not providing CGI information regarding the identity of the evaluators, the actual methodology used in evaluating competing proposals, and the individual scoring sheets and notes of each evaluator.

NOTICE TO INTERESTED PARTIES

The Commission posts on its Web site the decisions, notices of consultation and regulatory policies that it publishes, as well as information bulletins and orders. On April 1, 2011, the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure came into force. As indicated in Part 1 of these Rules, some broadcasting applications are posted directly on the Commission's Web site, www.crtc.gc.ca, under “Part 1 Applications.”

To be up to date on all ongoing proceedings, it is important to regularly consult “Today's Releases” on the Commission's Web site, which includes daily updates to notices of consultation that have been published and ongoing proceedings, as well as a link to Part 1 applications.

The following documents are abridged versions of the Commission's original documents. The original documents contain a more detailed outline of the applications, including the locations and addresses where the complete files for the proceeding may be examined. These documents are posted on the Commission's Web site and may also be examined at the Commission's offices and public examination rooms. Furthermore, all documents relating to a proceeding, including the notices and applications, are posted on the Commission's Web site under “Public Proceedings.”

Description of critical habitat of the Blanding's Turtle in Kejimkujik National Park of Canada

The Blanding's Turtle (Emydoidea blandingii), Nova Scotia population, is a species listed on Schedule 1 of the Species at Risk Act as endangered. The Blanding's Turtle is a mediumsized freshwater turtle readily distinguished by its bright yellow throat and chin. The Recovery Strategy for the Blanding's Turtle (Emydoidea blandingii), Nova Scotia Population, in Canada (www.sararegistry.gc.ca/species/speciesDetails_e.cfm?sid=276) identifies critical habitat for the species in a number of areas, including a federally protected area.

Notice is hereby given that, pursuant to subsection 58(2) of the Species at Risk Act, subsection 58(1) of that Act applies, 90 days after this publication, to the critical habitat of the Blanding's Turtle, Nova Scotia population — identified in the recovery strategy for that species in the Species at Risk Public Registry — that is located within the following federally protected area: Kejimkujik National Park of Canada, whose boundaries are described in Schedule 1 of the Canada National Parks Act. For greater certainty, the location of critical habitat parcels within this national park is indicated on the high-resolution map of critical habitat associated with the species' recovery strategy.

The Eastern Ribbonsnake (Thamnophis sauritus), Atlantic population is a species listed on Schedule 1 of the Species at Risk Act as threatened. The Eastern Ribbonsnake is a small, slender, semi-aquatic snake, which can be recognized by the three bright yellow stripes that run along the length of their dark body: one on each side and one along the back. The Recovery Strategy for the Eastern Ribbonsnake (Thamnophis sauritus), Atlantic population in Canada (www.sararegistry.gc.ca/species/speciesDetails_e.cfm?sid=728#docs) identifies critical habitat for the species in a number of areas, including a federally protected area.
