Her Excellency the Governor General in Council, on the recommendation of the Minister of Finance, pursuant to paragraph 16(2)(a) (see footnote a) of the Customs Tariff (see footnote b), hereby makes the annexed Regulations Amending the General Preferential Tariff and Least Developed Country Tariff Rules of Origin Regulations.

REGULATIONS AMENDING THE GENERAL PREFERENTIAL TARIFF AND LEAST DEVELOPED COUNTRY TARIFF RULES OF ORIGIN REGULATIONS

AMENDMENT

1. The schedule to the General Preferential Tariff and Least Developed Country Tariff Rules of Origin Regulations (see footnote 1) is replaced by the schedule set out in the schedule to these Regulations.

COMING INTO FORCE

2. These Regulations come into force on the day on which they are registered.

REGULATORY IMPACT
ANALYSIS STATEMENT

Issue and objectives

These Regulations will ensure that the General Preferential Tariff and Least Developed Country Tariff Rules of Origin Regulations are updated to align with the current schedule of the Customs Tariff in order to maintain their relevance and, as a result, contribute to the reduction of government administration costs and compliance costs for industry.

These Regulations involve no change in policy and are purely technical.

Description and rationale

Canada’s principal tariff treatments for developing and least developed countries, the General Preferential Tariff and the Least Developed Country Tariff, are implemented through the Customs Tariff. The treatments provide unilateral tariff preferences (e.g. free or lower rates of customs duty) aimed at stimulating the exports and economic growth of these countries. The General Preferential Tariff and Least Developed Country Tariff Rules of Origin Regulations set out the terms and conditions that goods imported into Canada from a country beneficiary to either of these tariff treatments must meet in order to benefit from these tariff preferences.

The schedule to the General Preferential Tariff and Least Developed Country Tariff Rules of Origin Regulations lists the tariff items for yarns, sewing threads, fabrics, apparel and made-up textile articles that may be imported into Canada from a least developed country and accorded preferential tariff treatment under these Regulations, provided certain conditions are met. The Regulations Amending theGeneral Preferential Tariff and Least Developed Country Tariff Rules of Origin Regulations replace the existing schedule to the General Preferential Tariff and Least Developed Country Tariff Rules of Origin Regulations with an updated version reflecting recent changes to the schedule to the Customs Tariff. These changes include alignment of the tariff items in the schedule with the changes to the Harmonized System (an internationally developed and implemented tariff classification system upon which the schedule of the Customs Tariff is based), which were implemented internationally on January 1, 2007, as well as the addition of new tariff items for goods that were formerly classified with other goods in the tariff items listed in the existing schedule to the Regulations.

Through alignment of the schedule to the Regulations with the tariff items in the current schedule to the Customs Tariff, these Regulations will facilitate use of the General Preferential Tariff and Least Developed Country Tariff Rules of Origin Regulations by industry and administration and monitoring by officials of the Canada Border Services Agency (CBSA).

These Regulations involve no change in policy and are revenue neutral.

Consultation

Given the purely technical nature of these amendments, no consultations were necessary.

Implementation, enforcement and service standards

The CBSA will monitor compliance with the terms and conditions of these regulations in the normal course of its administration of customs and tariff-related legislation and regulations.
