Nelly Bituala-Mayala Remission Order

Her Excellency the Governor General in Council, considering that the collection of the amount is unjust, on the recommendation of the Minister of National Revenue and the Treasury Board, pursuant to subsection 23(2.1) (see footnote a) of the Financial Administration Act (see footnote b) hereby remits to Nelly Bituala-Mayala the amount of $16,143, paid or payable by her as repayment of Canada child tax benefits with respect to the 2003 and 2004 base taxation years under Part I of the Income Tax Act (see footnote c).

EXPLANATORY NOTE

(This note is not part of the Order.)

The Order remits the amount of $16,143 with respect to Canada child tax benefits received by Nelly Bituala-Mayala in error, for the 2003 and 2004 base taxation years, to which she was not entitled. The remission is based on extreme hardship and an error on the part of the Canada Revenue Agency as to her entitlement to the benefits for that period.
