CANADA-EFTA FREE TRADE AGREEMENT IMPLEMENTATION ACT

Her Excellency the Governor General in Council, on the recommendation of the Minister for International Trade, pursuant to section 38 of the Canada-EFTA Free Trade Agreement Implementation Act, chapter 6 of the Statutes of Canada, 2009, hereby fixes July 1, 2009 as the day on which that Act comes into force.
EXPLANATORY NOTE

The Act being brought into force implements the Free Trade Agreement between Canada and the States of the European Free Trade Association (Iceland, Liechtenstein, Norway and Switzerland) (Canada-EFTA FTA), the Agreement on Agriculture between Canada and the Republic of Iceland, the Agreement on Agriculture between Canada and the Kingdom of Norway and the Agreement on Agriculture between Canada and the Swiss Confederation (bilateral Agricultural Agreements), signed by the Minister for International Trade in Davos, Switzerland, on January 26, 2008.
The general provisions of the Act specify that no recourse may be taken on the basis of the provisions of Part 1 of the Act or any order made under that Part, or the provisions of the Canada-EFTA FTA or the bilateral Agricultural Agreements themselves, without the consent of the Attorney General of Canada.
Part 1 of the Act approves the Canada-EFTA FTA and the bilateral Agricultural Agreements. It designates the Minister for International Trade as the principal representative of Canada on the Joint Committee and provides for the appointment by the Minister of other persons to be a representative of Canada on the subcommittee referred to in Article 9 of the Canada-EFTA FTA or on any subcommittee or working group established under Article 26 of the FTA, the payment by Canada of its share of the expenditures associated with the operation of the Joint Committee, arbitral tribunals, subcommittees and working groups, and authorizes the Governor in Council to make certain orders in accordance with Article 31 of the Canada-EFTA FTA.
Part 2 of the Act amends existing laws in order to bring them into conformity with Canada’s obligations under the Canada-EFTA FTA and the bilateral Agricultural Agreements.
Part 3 of the Act states that the provisions of the Act come into force on a day or days to be fixed by order of the Governor in Council.
