Regulations Amending Certain Regulations Made Under the Canada Post Corporation Act (Miscellaneous Program)

Whereas, pursuant to subsection 20(1) of the Canada Post Corporation Act (see footnote a), a copy of the proposed Regulations Amending Certain Regulations Made Under the Canada Post Corporation Act (Miscellaneous Program), in the annexed form, was published in the Canada Gazette, Part I, on June 28, 2008 and a reasonable opportunity was afforded to interested persons to make representations to the Minister of Transport with respect to the proposed Regulations;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to subsection 19(1) (see footnote b) of the Canada Post Corporation Act, hereby approves the annexed Regulations Amending Certain Regulations Made Under the Canada Post Corporation Act (Miscellaneous Program), made on August 28, 2008 by the Canada Post Corporation.

REGULATIONS AMENDING CERTAIN REGULATIONS MADE UNDER THE CANADA POST CORPORATION ACT (MISCELLANEOUS PROGRAM)

MATERIALS FOR THE USE OF THE BLIND REGULATIONS

1. The portion of section 3 of the French version of the Materials for the Use of the Blind Regulations (see footnote 1) before paragraph (a) is replaced by the following:

SOLICITATIONS BY MAIL REGULATIONS

2. The French version of the Solicitations by Mail Regulations (see footnote 2) is amended by replacing “objet transmissible” and “objets transmissibles” with “objet” and “objets”, respectively.

SPECIAL SERVICES AND FEES REGULATIONS

3. The French version of the Special Services and Fees Regulations (see footnote 3) is amended by replacing “objet transmissible” and “objets transmissibles” with “objet” and “objets”, respectively, in the following provisions:

(a) the portion of subsection 6(1) before paragraph (a);

(b) subsections 6(9) and (10);

(c) subsections 23(2), (3) and (4);

(d) subsections 23(5), (6) and (8);

(e) section 25;

(f) the heading before subsection 26;

(g) subsection 26(1);

(h) paragraph 26(3)(b);

(i) paragraph 26(3)(f); and

(j) subsections 26(5) and (6).

UNDELIVERABLE AND REDIRECTED MAIL REGULATIONS

4. Subsection 10(2) of the Undeliverable and Redirected Mail Regulations (see footnote 4) is replaced by the following:

(2) Where an item of undeliverable mail is incentive letter mail as defined in the Canada Postal Guide, addressed admail, publications mail, advertising or promotional matter addressed to householders, and bears on its cover the return address of a sender in Canada, it shall be handled in a manner that has been established by the Corporation.

5. Subsection 12(2) of the Regulations is replaced by the following:

(2) Where an item of undeliverable mail that is opened pursuant to section 11 is incentive letter mail as defined in the Canada Postal Guide, addressed admail, publications mail, advertising or promotional matter addressed to householders, it shall be handled in a manner that has been established by the Corporation.

MAIL RECEPTACLES REGULATIONS

6. The French version of the Mail Receptacles Regulations (see footnote 5) is amended by replacing “objets transmissibles par la poste” with “objets” in the following provisions:

(a) the definition “installation de dépôt de courrier” in section 2;

(b) paragraph 5(a);

(c) paragraph 6(b);

(d) subsection 2(2) of Schedule I;

(e) paragraph 2(3)(b) of Schedule I; and

(f) subparagraph 2(5)(g)(iii) of Schedule I.

7. The French version of the Regulations is amended by replacing “objets volumineux transmissibles par la poste” with “objets volumineux” in the following provisions:

(a) paragraph 2(3)(b) of Schedule I; and

(b) subparagraph 1(a)(ii) of Schedule II.

NON-MAILABLE MATTER REGULATIONS

8. Item 6 of the schedule to the French version of the Non-mailable Matter Regulations (see footnote 6) is amended by replacing “objets transmissibles” with “objets pouvant être transmis”.

COMING INTO FORCE

9. These Regulations come into force on the day on which they are registered.

ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Issue and objectives

These amendments to the Canada Post Corporation Act Regulations are of a technical nature and are to come into force on the day on which they are registered. They do not make any substantive changes to the Regulations made under the Canada Post Corporation Act.

Description and rationale

The Materials for the Use of the Blind Regulations along with the Special Services and Fees Regulations are being amended to ensure consistency between the English and the French versions. The amendments were requested by the Standing Joint Committee for the Scrutiny of Regulations.

A number of amendments are also being made to the French version of the Solicitations by Mail Regulations, the Special Services and Fees Regulations, the Mail Receptacles Regulations and the Non-mailable Matter Regulations to ensure consistency in terminology (e.g., “objets transmissibles” or “objets transmissibles par la poste” will be replaced by “objets”).

The amendments to the Undeliverable and Redirected Mail Regulations add a reference to Canada Postal Guide for purposes of clarity, as requested by the Standing Joint Committee for the Scrutiny of Regulations. Also, a reference to “publication mail” is added in the sections dealing with the manner in which Canada Post handles undeliverable mail. Amendments made to those regulations in 2003 (SOR/2003-376) set out the types of undeliverable mail items that the Corporation would not be required to return to the sender. The new amendment would add a reference to Publication Mail which was inadvertently excluded from the 2003 amendments.

Consultation

As required by the Canada Post Corporation Act, these amendments were pre-published in the Canada Gazette, Part I, on June 28, 2008, thereby initiating a formal 60-day period during which interested persons could make representations to the Minister of Transport, Infrastructure and Communities. During the consultation period, no comments were received.

Implementation, enforcement and service standards

These Regulations are enforced by Canada Post under the Canada Post Corporation Act. No increase in the cost of enforcement is expected as a result of the changes.
