AN ACT TO AMEND THE JUDGES ACT AND CERTAIN OTHER ACTS IN RELATION TO COURTS

Order Fixing October 1, 2008 as the Date of the Coming into Force of Sections 13 and 15 of the Act

Her Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to subsection 35(2) of An Act to amend the Judges Act and certain other Acts in relation to courts, chapter 11 of the Statutes of Canada, 2006, hereby fixes October 1, 2008 as the day on which sections 13 and 15 of that Act come into force.

EXPLANATORY NOTE

The Order fixes October 1, 2008, as the day on which sections 13 and 15 of An Act to amend the Judges Act and certain other Acts in relation to courts, chapter 11 of the Statutes of Canada, 2006, come into force.

Section 13 amends subsection 44(2) of the Judges Act and provides for the calculation of the annuity that is to be granted to the survivor of a judge in the case where the judge’s annuity has been divided and where it has not.

Section 15 adds sections 52.1 to 52.22 to the Judges Act. Those provisions establish a mechanism to divide judicial annuities on the breakdown of a conjugal relationship.
