BROADCASTING ACT

Whereas the Canadian Radio-television and Telecommunications Commission (“the Commission”) made a decision, contained within Broadcasting Decision CRTC 2008-129 of June 26, 2008, to renew the broadcasting licences of the TQS television network and the stations CFJP-TV Montréal, CFJP-DT Montréal, CFAP-TV Québec, CFKM-TV Trois-Rivières, CFKS-TV Sherbrooke and CFRS-TV Saguenay;
Whereas, subsequent to the making of the decision to renew the licences of the TQS network and the said affiliated stations, the Governor in Council received a petition requesting that the decision be referred back to the Commission for reconsideration and hearing of the matter;
And whereas, the Governor in Council, having considered that petition, is not satisfied that the decision derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act (see footnote a);
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act(see footnote b), hereby declines to refer back to the Commission for reconsideration and hearing the decision, contained within Broadcasting Decision CRTC 2008-129 of June 26, 2008, to renew the broadcasting licences of the TQS network and the stations CFJP-TV Montréal, CFJP-DT Montréal, CFAP-TV Québec, CFKM-TV Trois-Rivières, CFKS-TV Sherbrooke and CFRS-TV Saguenay.
