DETERMINATION

Information processing and related telecommunications services

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2009-130) on June 4, 2010, with respect to a complaint filed by Valcom Consulting Group Inc. (Valcom), of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. W8484-07AA15/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of informatics professional services.

Valcom alleged that PWGSC changed the evaluation criteria after the solicitation closed.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement, the Agreement on Government Procurement and the Canada-Chile Free Trade Agreement, the Tribunal determined that the complaint was valid.

(a) fulfills all of the measures set out in the Schedule that is appended to the conditions of licence set out in Broadcasting Decision 2004-129; and

(b) contributes an amount not less than 0.4% of its gross revenues from broadcasting activities to the independently administered fund to assist small market, independently owned broadcasters in meeting their commitments to local programming as set out in Broadcasting Public Notice 2003-38.

Renewal of the broadcasting licences for certain radio programming undertakings expiring August 31, 2010
Deadline for submission of interventions and/or comments: July 12, 2010

The Commission announces that it has received applications to renew the broadcasting licences for certain radio programming undertakings expiring August 31, 2010. The applications set out in the notice raise no concerns and are complete.

The licensees propose to operate their undertakings under the same terms and conditions as specified in the current licences and in the last renewal decisions, with the exception of Canadian talent development requirements, which have been replaced by the Canadian content development requirements set out in section 15 of the Radio Regulations, 1986.

The Commission intends to renew these broadcasting licences for a full seven-year term, subject to any interventions. The Commission notes that in addition to the conditions set out in the current licences, the renewed broadcasting licences will be subject to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, February 11, 2009.

In the list in the notice, stations identified with an asterisk (*) have been monitored by Commission staff. The monitoring report has been placed on each licensee’s public examination file. A copy can be obtained by contacting one of the Commission’s documentation centres.

The Commission notes that other such licences expiring in 2010 will be dealt with in separate notices of consultation.
