Notice is hereby given that the Canadian International Trade Tribunal made a decision on June 2, 2010, with respect to appeals filed by S.F. Marketing Inc. from decisions of the President of the Canada Border Services Agency dated March 25 and 30 and June 22, 2009, with respect to requests for redetermination pursuant to subsection 60(4) of the Customs Act.

The appeals, heard on February 17, 2010, pursuant to subsection 67(1) of the Customs Act, were dismissed.

Renewal of radio programming undertaking broadcasting licences due to expire August 31, 2010 — Licensees in apparent non-compliance

Deadline for submission of interventions and/or comments: July 6, 2010

The Commission announces that it has received broadcasting licence renewal applications for radio programming undertakings for which the licences are due to expire August 31, 2010. The licensees in notice 2010-334 have been found to be in apparent non-compliance with regulatory requirements during the current licence term. The following codes, A to G, identify the requirements with which the licensees are in apparent noncompliance:

  • A: failure to comply with the Radio Regulations, 1986 (the Regulations) relating to the broadcast of French-language vocal music;
  • B: failure to comply with the condition of licence relating to Canadian talent development (CTD) contributions;
  • C: failure to comply with subsection 15(2) of the Regulations relating to Canadian content development (CCD) contributions;
  • D: failure to comply with the Regulations as they relate to devoting 35% or more of musical selections from content category 2 (popular music) to Canadian selections broadcast in their entirety;
  • E: failure to comply with the Regulations as they relate to devoting 10% or more of musical selections from content category 3 (special interest music) to Canadian selections broadcast in their entirety;
  • F: failure to comply with subsection 9(2) of the Regulations relating to the provision of annual reports;
  • G: failure to comply with subsection 8(6) of the Regulations relating to logger tapes.
