CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-06608 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

 1. Permittee: Ocean Pride Fisheries Limited, Lower Wedgeport, Nova Scotia.

 2. Waste or other matter to be disposed of: Fish waste and other organic matter resulting from industrial fish processing operations.

2.1. Nature of waste or other matter: Fish waste and other organic matter consisting of dogfish and sea cucumber waste and associated liquid wastes.

 3. Duration of permit: Permit is valid from June 1, 2010, to November 15, 2010.

 4. Loading site(s): Wedgepoint Wharf, Lower Wedgeport, Nova Scotia, 43°42.90′ N, 65°58.10′ W (NAD83).

 5. Disposal site(s): Offshore of Tusket Islands, within a 500 m radius of 43°34.12′ N, 66°04.73′ W (NAD83), at an approximate depth of 40 m.

 6. Method of loading: The Permittee shall ensure that the material is loaded onto floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

6.1. The Permittee shall ensure that the waste to be disposed of is covered by netting or other material to prevent access by gulls and other marine birds, except during direct loading or disposal of the waste.

6.2. The Permittee shall ensure that the waste is securely contained within a hold or other suitable container and not carried or stored loose on deck.

6.3. Material loaded for the purpose of disposal at sea may not be held aboard any ship for more than 96 hours from the commencement of loading without the written consent of an enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999.

6.4. The loading and transit shall be completed in a manner that ensures that no material contaminates the marine environment, notably the harbour and adjacent beaches. The Permittee shall also ensure that the loading sites are cleaned up and, if necessary, that spilled wastes are recovered.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site.

 8. Method of disposal: The Permittee shall ensure that the waste to be disposed of shall be discharged from the equipment or ship while steaming within the disposal site boundaries and in a manner which will promote dispersion.

 9. Total quantity to be disposed of: Not to exceed 5 000 tonnes.

10. Inspection: By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

10.1. Ships operating under the authority of this permit shall carry and display a radar-reflecting device at all times mounted on the highest practical location.

11. Contractors: The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

11.1. The Permittee shall ensure that all contractors involved in the loading or disposal activity for which the permit is issued are made aware of the conditions identified in the permit and of possible consequences of any violation of these conditions.

12. Reporting and notification: The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: name or number of ship, platform or structure used to carry out the loading and/or disposal, name of the contractor including corporate and on-site contact information, and expected period of loading and disposal activities. The above-noted information shall be submitted to

12.1. The Permittee shall submit a written report to the Minister, as represented by the Regional Director of the Environmental Protection Operations Directorate, c/o Jayne Roma, as identified in paragraph 12(a), within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity of matter disposed of at the disposal site(s) and the dates on which disposal activities occurred.

12.2. This permit shall be displayed in an area of the plant accessible to the public.

 5. Disposal site(s): O’Donnell’s, within a 250 m radius of 47°04.00′ N, 53°38.00′ W (NAD83), at an approximate depth of 50 m.

Order 2010-87-04-02 Amending the Non-domestic Substances List

Whereas, pursuant to subsections 87(1) and (5) of the Canadian Environmental Protection Act, 1999 (see footnote a), the Minister of the Environment has added the substance referred to in the annexed Order to the Domestic Substances List (see footnote b);

Therefore, the Minister of the Environment, pursuant to subsections 87(1) and (5) of the Canadian Environmental Protection Act, 1999 (see footnote c), hereby makes the annexed Order 2010-87-04-02 Amending the Non-domestic Substances List.

RADIOCOMMUNICATION ACT

Notice No. SMSE-006-10 — New issues of SRSP-511 and RSS-119

Notice is hereby given that Industry Canada is releasing the following documents:

  • Standard Radio System Plan 511 (SRSP-511), Issue 2: Technical Requirements for Land Mobile and Radio Services Operating in the Bands 768-776 MHz and 798-806 MHz, which sets out the minimum technical requirements for the efficient utilization of these bands; and
  • Radio Standards Specification 119 (RSS-119), Issue 10: Land Mobile and Fixed Radio Transmitters and Receivers Operating in the Frequency Range 27.41-960 MHz, which sets out the requirements for radio transmitters and receivers for the land mobile and fixed services in bands allocated within the 27.41 MHz to 960 MHz range.

The above-mentioned documents were updated to provide requirements for land mobile equipment operating in the bands 764-776 MHz and 794-806 MHz. These standards reflect changes in accordance with a new radio system policy announced in Canada Gazette Notice DGTP-007-09 (published on July 4, 2009), which outlines how these frequency bands will be used for public safety applications.

General information

The documents SRSP-511, Issue 2, and RSS-119, Issue 10, will come into force as of the date of publication of this notice.

These documents have been coordinated with industry through the Radio Advisory Board of Canada (RABC).

The Radio Equipment Technical Standards Lists will be amended to include the relevant changes.

Interested parties should submit their comments within 120 days of the date of publication of this notice. Soon after the close of the comment period, all comments received will be posted on Industry Canada’s Spectrum Management and Telecommunications Web site at www.ic.gc.ca/spectrum.

Submitting comments

Respondents are requested to provide their comments in electronic format (WordPerfect, Microsoft Word or Adobe PDF) to the Manager, Fixed Wireless Systems, for the SRSP, and to the Manager, Radio Equipment Standards, for the RSS, along with a note specifying the software, version number and operating system used.

Written submissions should be addressed to the Director General, Engineering, Planning and Standards Branch, 300 Slater Street, Ottawa, Ontario K1A 0C8.

All submissions should cite the Canada Gazette, Part I, the publication date, the title and the notice reference number (SMSE-006-10).

Saint John Port Authority —Supplementary letters patent

BY THE MINISTER OF TRANSPORT

WHEREAS Letters Patent were issued by the Minister of Transport (“Minister”) for the Saint John Port Authority (“Authority”) under the authority of the Canada Marine Act (“Act”) effective May 1, 1999;

WHEREAS Schedule B of the Letters Patent describes the federal real property managed by the Authority;

WHEREAS, pursuant to subsection 44(5) of the Act, the Authority has informed the Minister that the federal real property described below as Parcel “A” is no longer required for port purposes;

AND WHEREAS the board of directors of the Authority has requested that the Minister issue Supplementary Letters Patent to remove the federal real property described below as Parcel “A” from the management of the Authority by deleting the said property from Schedule B of the Letters Patent;

NOW THEREFORE under the authority of section 9 of the Act, the Letters Patent are amended by deleting from Parcel 1 of Schedule B of the Letters Patent the federal real property described below as Parcel “A” by adding the following at the end of the description of Parcel 1 of Schedule B of the Letters Patent:
