PROPOSED REGULATORY TEXT

Notice is hereby given that the Governor in Council, pursuant to section 5 (see footnote a) of the Hazardous Products Act (see footnote b), proposes to make the annexed Regulations Amending the Surface Coating Materials Regulations.

Interested persons may make representations concerning the proposed Regulations within 75 days after the date of publication of this notice. REGULATIONS AMENDING THE SURFACE COATING MATERIALS REGULATIONS

AMENDMENTS

1. Subsection 4(1) of the Surface Coating Materials Regulations (see footnote 1) is replaced by the following:

Concentration and test method criteria

4. (1) The concentration of total lead present in a surface coating material must not be more than 90 mg/kg when a dried sample of it is tested in accordance with a method that conforms to good laboratory practices.

2. Subsection 5(1) of the Regulations is replaced by the following:

Lead-content information

5. (1) If the concentration of total lead present in a surface coating material that is used for a purpose described in subsection 4(2) is more than 90 mg/kg, the display panel must contain the following information or its equivalent:

CONTAINS LEAD / CONTIENT DU PLOMB

DO NOT APPLY TO SURFACES ACCESSIBLE TO CHILDREN OR PREGNANT WOMEN.

NE PAS APPLIQUER SUR UNE SURFACE ACCESSIBLE AUX ENFANTS OU AUX FEMMES ENCEINTES.

Must be used exclusively [Insert the appropriate use or uses described in subsection 4(2)]. / Utiliseruniquement aux fins suivantes : [insérer les fins mentionnées au paragraphe 4(2) qui s’appliquent].

3. Section 8 of the Regulations is replaced by the following:

Lead in pavement markings

8. The concentration of total lead present in a surface coating material that is used for pavement markings and that is sold during the period beginning on the day on which these Regulations come into force and ending on December 31, 2010 may be more than 90 mg/kg, when a dried sample of it is tested in accordance with a method that conforms to good laboratory practices, if the display panel contains the information required by section 5.

COMING INTO FORCE

4. These Regulations come into force on the day on which they are registered.
