Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-06560 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

 1. Permittee: Saint John Port Authority, Saint John, New Brunswick.

 2. Waste or other matter to be disposed of: Dredged material.

2.1. Nature of waste or other matter: Dredged material consisting of silt, sand, clay and gravel.

 3. Duration of permit: Permit is valid from July 1, 2009, to June 30, 2010.

3.1. The loading and disposal at sea activities are restricted to the following periods: from July 1, 2009, to November 8, 2009, and January 15, 2010, to March 30, 2010.

 4. Loading site(s): Saint John Harbour and Courtenay Bay, Saint John, New Brunswick, at approximately 45°16.00′ N, 66°04.00′ W (NAD83). The loading of dredged materials authorized by this permit is restricted to the following locations:

Main Channel; Berth No. 1/2, and End of Pier 2/3, Navy Island; Berth No. 3, Rodney Slip; Pugsley A/B/C; Lower Cove; Rodney Marginal; Berth No. 12, Terminal No. 12; Long Wharf Marginal and Approach; Courtenay Bay Channel, Basin, and Potash Terminal, as described in Appendix B, Figure B.1 titled “Sample Grid — 2009 Dredging Program Cover Sheet (November 2008)” submitted in support of the permit application.

 5. Disposal site(s): Black Point: 45°12.68′ N, 66°01.10′ W (NAD83).

 6. Method of loading: Dredging will be carried out using a clamshell dredge.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site via towed or self-propelled barges.

 8. Method of disposal: Disposal shall take place in accordance with the dredged material disposal plan required by paragraph 14 of this permit.

 9. Total quantity to be disposed of: Not to exceed 450 000 m3 scow measure.

10. Fees: The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

11. Inspection:

11.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11.2. Ships operating under the authority of this permit shall be marked in accordance with the Collision Regulations of the Canada Shipping Act when located on or in the waterway.

12. Contractors: The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

13. Reporting and notification:

13.1. The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: name or number of ship, platform or structure used to carry out the loading and/or disposal, name of the contractor including corporate and on-site contact information, and expected period of loading and disposal activities. The above-noted information shall be submitted to

13.2. The Permittee shall submit a written report to the Minister, as represented by the Regional Director of Environmental Protection Operations Directorate, c/o Adrian MacDonald, as identified in paragraph 13.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity of matter disposed of at the disposal site and the dates on which disposal activities occurred.

13.3. At all times, a copy of this permit and of documents and drawings referenced in this permit shall be available at the loading site and on all powered ships directly engaged in the loading and disposal operations.

14. Special precautions:

14.1. The loading and disposal at sea referred to under this permit shall be carried out in accordance with the mitigation measures summarized in Table 10.1 of the environmental assessment report titled “CEAA Screening — 2009 Maintenance Dredging Project, Saint John, New Brunswick” (May 2009).

14.2. The Permittee shall submit a dredged material disposal plan to Mr. Adrian MacDonald, identified in paragraph 13.1, for approval by Environment Canada prior to commencement of the first dredging operation authorized by this permit. The plan shall address procedures to accurately measure or estimate quantities of dredged material disposed of at the disposal site(s), vessel tracking, and a schedule for use of the disposal sites. Modifications to the plan shall be made only with the written approval of Environment Canada.

Notice of intent to develop and implement Extended Producer Responsibility regulations to manage the end-of-life of ozone-depleting substances and their halocarbon alternatives

Notice is hereby given that the Minister of the Environment intends to establish regulations under the Canadian Environmental Protection Act, 1999 to manage the end-of-life of ozone-depleting substances and their halocarbon alternatives.

1. Context

There is a growing concern, both internationally and domestically, regarding the lack of sound management of end-of-life ozone-depleting substances (ODSs). While global and domestic existing controls manage the front end (production, import, export and use) of ODSs, there is an important gap in the efficient management of ODSs at the end of their life. Inappropriate treatment or disposal of ODSs when they reach their end-of-life leads to their release to the environment, which has negative impacts on both ozone layer and climate.

Canada has a program at the federal level to manage the production, import, export and use of ODSs. Provincial and territorial legislation also establishes measures to prevent the release of ODSs during their useful life. In addition, provincial and territorial legislation covers the recovery and recycling of refrigerants for servicing and re-use in all industry sectors. However, it does not establish provisions for managing the collection, storage, transport and destruction of unwanted ODSs.

While there are industry-led voluntary programs for the collection and disposal of surplus ozone-depleting refrigerants, these programs are experiencing limitations in scope, funding and participation across industry sectors. These industry-led programs target the stationary refrigeration and air conditioning sectors only, which represents 35% of the consumption of ODS refrigerants in all refrigeration and air conditioning sectors. Mobile refrigeration, mobile air conditioning and domestic appliances would account for the remaining 65%.

At this time, the main alternative for ODSs in refrigeration and air conditioning applications are hydrofluorocarbons (HFCs). To a much lesser extent, perfluorocarbons (PFCs) are also being introduced as alternatives to ODSs in this sector in specialized applications. While these do not have any ozone-depleting potential, they are greenhouse gases covered by the Kyoto Protocol.

2. Rationale for action

Globally, Parties to the Montreal Protocol have recognized that “the main mitigation strategies likely to have an effect on ODS emissions in the mid-term (e.g. as of 2008) are those associated with end-of-life measures in refrigeration and both mobile and stationary air conditioning”. (see footnote 1) Recovery and possible destruction may have a significant impact to further protect the ozone layer and the climate from releases of ODSs in use in existing equipment.

The need for an Extended Producer Responsibility (EPR) program to avoid the ultimate release of ODSs and their alternatives was recognized early on in Canada. Two national initiatives under the Canadian Council of Ministers of the Environment (CCME) called for an EPR program, namely Canada’s Strategy to Accelerate the Phase-Out of CFC and Halon Uses and to Dispose of the Surplus Stocks and the May 2001 National Action Plan for the Environmental Control of Ozone-Depleting Substances (ODS) and their Halocarbon Alternatives. This National Action Plan (NAP) identified the need to develop and implement control measures to support extended producer responsibility programs.

While industry has taken the lead in the development and implementation of voluntary EPR programs for certain ODSs, a regulation is now needed to ensure that a level playing field exists across Canada. These industry-led programs target surplus ozone-depleting refrigerants only, not their HFC or PFC alternatives. In addition, they are limited to the stationary refrigeration and air conditioning sectors only.

The establishment of Extended Producer Responsibility regulations would address existing gaps in the life cycle management of ODSs and their halocarbon alternatives (HFCs and PFCs).

It would also lead to important environmental benefits for both ozone and climate protection since ODSs and their halocarbon alternatives (HFCs and PFCs) are potent greenhouse gases and are also known to contribute to climate change.

In Canada, preliminary estimates indicate that approximately 1 000 metric tonnes of chlorofluorocarbons (CFCs) and 24 000 metric tonnes of hydrochlorofluorocarbons (HCFCs) are still in use in stationary equipment (e.g. commercial chillers), which translates into an estimated 2 300 ozone-depleting potential tonnes or 48 megatonnes CO2 equivalent. Up to an additional 45 000 metric tonnes of ODSs is believed to be used in mobile refrigeration, mobile air conditioning and domestic appliances, which translates to an estimated 3 000 ozone-depleting potential tonnes or 80 megatonnes CO2 equivalent.

Environment Canada believes that Extended Producer Responsibility regulations would establish the best direct measure to make producers and/or distributors responsible at the post-consumer stage with a legally binding scope and targets to ensure the environmentally sound management of these substances at their end-of-life.

3. Proposed Scope

The proposed regulations would cover ODS (CFCs and HCFCs) as well as their halocarbon alternatives (HFCs and PFCs) used in

  • stationary air conditioning (residential, commercial or industrial applications);
  • stationary refrigeration (commercial or industrial applications); and
  • mobile air conditioning and refrigeration (commercial or industrial applications).

At this time, the proposed regulations would not target ODS and their halocarbon alternatives in

  • domestic appliances. Some provinces/municipalities have already established programs for the collection of domestic appliances (e.g. white goods, such as a refrigerator). Environment Canada will continue its work with provinces/municipalities to explore ways to improve on the collection, use, transport and destruction of contaminated ozone-depleting substances and halocarbon alternatives from these appliances.
  • insulating foams. Recovery of ozone-depleting substances used as blowing agents in insulation foams for buildings, for example, is a lot more complex and expensive than the recovery of refrigerants, although it can be done in practice and could be considered in the longer term.

Under the proposed regulations, participation in a stewardship program would be mandated by requiring the regulated community to

  • prepare a plan for a stewardship program that meets specified requirements; or
  • join an existing stewardship program for which such a plan was prepared.

The regulated community could include manufacturers and importers of bulk refrigerants, reclamation facilities and wholesalers. The proposed regulations will not deal with the recovery and recycling of refrigerants during their useful life.

4. Public comment period

Any person may file, within 60 days of publication of this notice, with the Minister of the Environment, comments with respect to this proposal. Annex 1

Definitions

Chlorofluorocarbons (CFCs): A fully halogenated molecule which contains one, two or three carbon atoms and at least one atom each of chlorine and fluorine. These substances have an ozone-depleting potential as well as global-warming potential.

Extended Producer Responsibility: An environmental policy approach in which a producer’s responsibility, physical and/or financial, for a product is extended to the post-consumer stage of a product’s life cycle. There are two key features of EPR policy: (1) the shifting of responsibility (physically and/or economically, fully or partially) upstream to the producer and away from municipalities, and (2) to provide incentives to producers to take environmental considerations into the design of the product.

Halocarbon: A carbon-based compound that may contain hydrogen, fluorine, chlorine, bromine or iodine in its structure.

Hydrochlorofluorocarbons (HCFCs): A chemical compound with molecules that contain one, two or three carbon atoms and at least one atom each of hydrogen, chlorine and fluorine. These substances have been used as transitional alternatives for CFCs as they have lower ozone-depleting potential. They also have high global warming potential.

Hydrofluorocarbons (HFCs): A chemical compound that contains only fluorine, carbon and hydrogen, no chlorine or bromine. HFCs are not ODS but have a global warming potential. They are used as replacements of CFCs and HCFCs.

Level Playing Field: The establishment of the same rules for all participants in an identified industry sector, geographical location or competitive sphere so as to remove barriers or increased costs that may exist for some participants and not for others.

Ozone-depleting Substance (ODS): A chemical compound that contributes to stratospheric ozone depletion. ODS are stable in the troposphere and only degrade under intense ultraviolet light in the stratosphere. ODS react with stratospheric ozone, either directly or through the release of chlorine or bromine atoms after decomposition.

Perfluorocarbons (PFCs): A chemical compound that contains only fluorine and carbon. PFCs are not ODS but have a global warming potential. They are used as substitutes for HCFCs in some specialized applications.

Changes in the new issue include

— clarification of the registration process for handset telephones (see section 1.2) subject to the requirements of Compliance Specification (CS-03), Part V;

— clarification of the concepts of “Multiple Listing” and “Transfer of Ownership,” sections 6.7 and 6.8 respectively; and

— addition of a new audit requirement affecting Canadian representatives of Declaring Parties, section 7.3.

Issue 3 of DC-01 will come into effect upon publication of this notice.

Interested parties should submit their comments within 75 days of the date of publication of this notice. Soon after the close of the comment period, all comments received will be posted on Industry Canada’s Spectrum Management and Telecommunications Web site at http://ic.gc.ca/spectrum.

— technical and editorial changes affecting some PSD mask definitions (see Tables 3.2.1.1, 3.2.1.2, 3.2.1.3(a), 3.2.1.3(b), 3.2.1.4(a), 3.2.1.4(b), 3.2.1.5(a), 3.2.1.5(b), 3.2.1.8(a) and 3.2.1.9(a)); and

— deletion of sections 3.2.1.6: ATU-R PSD Mask Definition (ADSL2+ with Extended Downstream Above POTS), and 3.2.1.7: ATU-R PSD Mask Definition (ADSL2+ All Digital Mode).

Amendment 4 to Issue 9 of CS-03, Part VIII, will come into effect upon publication of this notice.

Interested parties should submit their comments within 75 days of the date of publication of this notice. Soon after the close of the comment period, all comments received will be posted on Industry Canada’s Spectrum Management and Telecommunications Web site at http://ic.gc.ca/spectrum.
