Further to its Broadcasting Notice of Consultation CRTC 2009-132, March 11, 2009, the Commission announces the following:

On May 1, 2009, the Canadian Broadcasting Corporation (CBC) filed a letter with the Commission in which it stated that it “does not contest the Commission’s preliminary view that bold’s programming may be inconsistent with its nature of service that was communicated in [Broadcasting] Notice of Consultation 2009-132.”

In Broadcasting Notice of Consultation 2009-132, the Commission indicated that the CBC’s actions appear to negatively impact the integrity of the licensing process since Land and Sea, which was launched as Country Canada and rebranded as bold, was approved to provide a particular service for a particular underserved audience, which it is not doing at this time. In addition, the programming changes appear to be inconsistent with the Commission’s policy on program genre exclusivity articulated in Regulatory framework for broadcasting distribution undertakings and discretionary programming services, Broadcasting Public Notice CRTC 2008-100, October 30, 2008.

In its letter, the CBC indicated that the rebranding of Country Canada to bold was never intended to challenge the integrity of the Commission’s licensing process. It added that the rebranding of its service could occur without the need for a licence amendment and that the service could remain in conformity with its nature of service condition of licence.

The CBC further noted that the publication of Broadcasting Notice of Consultation 2009-132 “indicates to the CBC that the Commission does not share this view, and that an amendment to bold’s nature of service condition of licence is the appropriate course of action.”

In light of the above, the CBC is requesting that bold’s nature of service condition of licence, which currently reads:

The licensee shall provide a national English-language Category 1 specialty television service for rural Canadian families, with a focus on adults 25-54. The service will provide information, interaction and entertainment from a rural perspective.

be replaced with the following:

The licensee shall provide a national English-language Category 1 specialty television service for rural Canadians. The service will provide information, interaction and entertainment.

Given that the CBC does not contest the Commission’s preliminary view that bold’s programming may be inconsistent with its nature of service condition of licence, the Commission suspends the public hearing that was to be held on June 2, 2009, pending the disposition of this application.

The Commission notes that the details of the application filed by the CBC will be announced shortly in a notice of consultation.

Following the consideration of the application, the Commission will determine if a mandatory order requiring the CBC to conform to its original condition of licence concerning the nature of service definition for bold should be issued.

The Commission announces that the Association des radios régionales francophones (ARRF) will be making a presentation to the panel at the commencement of the hearing at 9:00 a.m. in connection with a study concerning its members, as more fully described below. The presentation will be followed by clarification questions if required. The first applicant is expected to be heard at 9:30 a.m.

The study consists of two documents titled “Étude 2009 — Cahier 1 — Portrait des membres” and “Vision d’ensemble : Les contextes et l’industrie — Cahier 2 — Données connexes au sondage 2009.” The study has been placed on the public record.

Application by 591991 B.C. Ltd. to renew the broadcasting licence for the French-language commercial radio programming undertaking CKRS-FM Chicoutimi. The licence expires on August 31, 2009.

It appears to the Commission that the licensee may have failed to comply with sections 2.2(5) and 2.2(8) of the Radio Regulations, 1986 concerning the broadcast of French-language vocal music and the broadcast of Canadian content for category 2 music during the broadcast week of September 14 to 20, 2008.

The licensee may have also failed to comply with section 2.2(5) of the Radio Regulations, 1986 concerning the broadcast of French-language vocal music during the broadcast week of March 29 to April 4, 2009. The licensee may have also failed to comply with its condition of licence that stipulates that not less than 50% of the programming broadcast during the broadcast week be drawn from category 1 (Spoken Word).

The Commission intends to inquire into this matter at the hearing.

This station has been monitored by Commission staff. A copy of the monitoring report has been placed on the licensee’s public examination file and can be obtained by contacting the Commission documentation centres.

Columbia Power Corporation

By an application dated May 22, 2009, Columbia Power Corporation (the “Applicant”) has applied to the National Energy Board (the “Board”), under Division II of Part VI of the National Energy Board Act (the “Act”), for authorization to export 350 MW of firm or interruptible power and annually up to 1 000 GWh per year of either firm or interruptible energy for a period of 10 years commencing on June 1, 2009.

The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The directions on procedure that follow explain in detail the procedure that will be used.

1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at 445 13th Avenue, Suite 200, Castlegar, British Columbia V1N 1G1, 250-304-6060 (telephone), and provide a copy of the application to any person who requests one. (b) the impact of the exportation on the environment; and

(c) whether the Applicant has

(i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and

(ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.
