Tr’ondëk Hwëch’in First Nation Final Agreement — Amendment to Chapter 13, Schedule B, Section 8.1

Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, and pursuant to section 2.3.5.1 of the Tr’ondëk Hwëch’in First Nation Final Agreement, hereby consents to the amendments to the Tr’ondëk Hwëch’in First Nation Final Agreement as set out in the attached schedule.

Schedule

Article 8.1 of Schedule B to Chapter 13 of the Tr’ondëk Hwëch’in Final Agreement is replaced with the following:

8.1 The Site, including all improvements made to the Site for the purpose of achieving the objectives set out in 2.1 and 2.2 of this schedule, shall be exempt from Property Taxes for a period of 5 years from the day this provision comes into effect or until the negotiation and conclusion of a taxation agreement as referred to in 8.2, whichever occurs earlier. The exemption may be extended for such further time as may be agreed upon in writing by the Yukon Minister with responsibility for land claims on behalf of Yukon and the Tr’ondëk Hwëch’in Council on behalf of the Tr’ondëk Hwëch’in.

8.1.1 Property Taxes in respect of the Site for the period from September 15, 2003, until the day this provision comes into effect are hereby forgiven.
