CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Order 2006-87-07-01 Amending the Domestic Substances List

Whereas the Minister of the Environment has been provided with information under either paragraph 87(1)(a) or (5)(a) of the Canadian Environmental Protection Act, 1999 (see footnote a) in respect of each substance referred to in the annexed Order;

Whereas, in respect of the substances being added to the Domestic Substances List pursuant to subsection 87(1) of that Act, the Minister of the Environment and the Minister of Health are satisfied that those substances have been manufactured in or imported into Canada in excess of the quantity prescribed under the New Substances Notification Regulations (Chemicals and Polymers) by the person who provided the information;

Whereas the period for assessing the information under section 83 of that Act has expired;

And whereas no conditions under paragraph 84(1)(a) of that Act in respect of the substances are in effect;

Therefore, the Minister of the Environment, pursuant to subsections 87(1), (3) and (5) of the Canadian Environmental Protection Act, 1999 (see footnote b), hereby makes the annexed Order 2006-87-07-01 Amending the Domestic Substances List.

ORDER 2006-87-07-01 AMENDING THE
DOMESTIC SUBSTANCES LIST

AMENDMENT

1. Part 2 of the Domestic Substances List (see footnote 1) is amended by adding the following in numerical order:

354-33-6 T-S Any activity involving, in a calendar year, more
than 1 000 kg of Ethane, pentafluoro-, other than
its use in closed loop cooling systems, whether for refrigeration or air conditioning, or as a fire
suppressant, aerosol propellant or solvent,
or its importation or manufacture for such
a use.
  The following information must be provided to the Minister, at least 90 days before the beginning of the proposed new activity:
  (a) a description of the proposed significant new activity in relation to the substance;
  (b) the information specified in Schedule 4 to the New Substances Notification Regulations (Chemicals and Polymers);
  (c) the information specified in item 8 and paragraphs 10(a) to (d) of Schedule 5 to those Regulations;
  (d) the pollution prevention measures proposed to
prevent or reduce releases of the substance into the environment; and
  (e) the specific substance name, the Chemical Abstracts Service registry number (if one has been assigned) and the molecular formula of the substance it is replacing.
  The above information will be assessed within 90 days after it is received by the Minister.
406-58-6 T-S Any activity involving, in a calendar year, more
than 1 000 kg of 1,1,1,3,3-Pentafluorobutane, other
than its use as a foam-blowing agent, cleaning agent,
diluent or solvent, or its importation or manufacture for
such a use.
  The following information must be provided to the Minister, at least 90 days before the beginning of the proposed new activity:
  (a) a description of the proposed significant new activity in relation to the substance;
  (b) the information specified in Schedule 4 to the New Substances Notification Regulations (Chemicals and Polymers);
  (c) the information specified in item 8 and paragraphs 10(a) to (d) of Schedule 5 to those Regulations;
  (d) the pollution prevention measures proposed to
prevent or reduce releases of the substance into the environment; and
  (e) the specific substance name, the Chemical Abstracts Service registry number (if one has been assigned) and the molecular formula of the substance it is replacing.
  The above information will be assessed within 90 days after it is received by the Minister.
420-46-2 T-S Any activity involving, in a calendar year, more
than 1 000 kg of Ethane, 1,1,1-trifluoro-, other than its
use in closed loop cooling systems, whether for refrigeration or air conditioning, or its importation or manufacture for such a use.
  The following information must be provided to the Minister, at least 90 days before the beginning of the proposed new activity:
  (a) a description of the proposed significant new activity in relation to the substance;
  (b) the information specified in Schedule 4 to the New Substances Notification Regulations (Chemicals and Polymers);
  (c) the information specified in item 8 and paragraphs 10(a) to (d) of Schedule 5 to those Regulations;
  (d) the pollution prevention measures proposed to prevent or reduce releases of the substance into the environment; and
  (e) the specific substance name, the Chemical Abstracts Service registry number (if one has been assigned) and the molecular formula of the substance it is replacing.
  The above information will be assessed within 90 days after it is received by the Minister.
431-89-0 T-S Any activity involving, in a calendar year, more
than 1 000 kg of Propane, 1,1,1,2,3,3,3-heptafluoro-, other than its use in closed loop cooling systems, whether for refrigeration or air conditioning, or as a fire suppressant or aerosol propellant, or its importation or manufacture for such a use.
The following information must be provided to the Minister, at least 90 days before the beginning of the proposed new activity:
  (a) a description of the proposed significant new activity in relation to the substance;
  (b) the information specified in Schedule 4 to the New Substances Notification Regulations (Chemicals and Polymers);
  (c) the information specified in item 8 and paragraphs 10(a) to (d) of Schedule 5 to those Regulations;
  (d) the pollution prevention measures proposed to
prevent or reduce releases of the substance into the environment; and
  (e) the specific substance name, the Chemical Abstracts Service registry number (if one has been assigned) and the molecular formula of the substance it is replacing.
  The above information will be assessed within 90 days after it is received by the Minister.
690-39-1 T-S Any activity involving, in a calendar year, more
than 1 000 kg of Propane, 1,1,1,3,3,3-hexafluoro-,
other than its use in closed loop cooling systems,

  The following information must be provided to the Minister, at least 90 days before the beginning of the proposed new activity:
  (a) a description of the proposed significant new activity in relation to the substance;
  (b) the information specified in Schedule 4 to the New Substances Notification Regulations (Chemicals and Polymers);
  (c) the information specified in item 8 and paragraphs 10(a) to (d) of Schedule 5 to those Regulations;
  (d) the pollution prevention measures proposed to prevent or reduce releases of the substance into the environment; and
  (e) the specific substance name, the Chemical Abstracts Service registry number (if one has been assigned) and the molecular formula of the substance it is replacing.
  The above information will be assessed within 90 days after it is received by the Minister.

COMING INTO FORCE

2. This Order comes into force on November 29, 2006.
