Regulations Amending the Quebec Fishery Regulations, 1990 and Certain Other Fisheries Regulations

Her Excellency the Governor General in Council, on the recommendation of the Minister of Fisheries and Oceans, pursuant to subsection 36(5) and section 43 (see footnote a) of the Fisheries Act, hereby makes the annexed Regulations Amending the Quebec Fishery Regulations, 1990 and Certain Other Fisheries Regulations.

REGULATIONS AMENDING THE QUEBEC FISHERY REGULATIONS, 1990 AND CERTAIN OTHER FISHERIES REGULATIONS

QUEBEC FISHERY REGULATIONS, 1990

1. (1) The definition "Société" in subsection 2(1) of the Quebec Fishery Regulations, 1990 (see footnote 1) is repealed.

(2) Paragraph (b) of the definition "Minister" in subsection 2(1) of the Regulations is replaced by the following:

(b) in all other cases, the Minister of Natural Resources, Wildlife and Parks of Quebec or the Associate Minister of Forests, Wildlife and Parks for Quebec; (ministre)

(3) Subsection 2(1) of the Regulations is amended by adding the following in alphabetical order:

"Director" means a person who works in the Wildlife Sector of the Ministry, and who occupies a managerial position with respect to fisheries; (directeur)

"Ministry" means the Ministry of Natural Resources, Wildlife and Parks of Quebec; (ministère)

2. (1) Subsection 4(3) of the Regulations is replaced by the following:

(3) The Minister may vary any close time fixed by the Aboriginal Communal Fishing Licences Regulations in respect of species of fish or waters referred to in subsection 3(1) so that the variation applies to all of the waters or to any portion of them.

(2) Paragraph 4(4)(d) of the Regulations is replaced by the following:

(d) transmitting or posting the notice by electronic means;

3. (1) Subparagraph 5(2)(c.1)(ii) of the Regulations is replaced by the following:

(ii) is the child of the spouse or common-law partner of the holder of a licence referred to in Part I of Schedule XXVII,

(2) Subparagraph 5(2)(c.2)(ii) of the Regulations is replaced by the following:

(ii) is the child of the spouse or common-law partner of the holder of a licence referred to in Part I of Schedule XXVII,

(3) Paragraph 5(2)(h) of the Regulations is replaced by the following:

(h) a resident under 18 years of age who is engaged in sport fishing, for species other than anadromous Atlantic salmon, and who is in possession of a certificate attesting to the resident's participation in the Quebec Wildlife Foundation program "Pêche en herbe" or in the Ministry program "Relève à la pêche".

4. (1) Subsection 13(2) of the Regulations is replaced by the following:

(2) Subject to subsection (3), every person who catches and retains an anadromous Atlantic salmon shall immediately detach a valid tag issued with the person's licence and affix it to the fish in the sequence in which it is attached to the licence.

(2) Paragraph 13(4)(b) of the Regulations is replaced by the following:

(b) it can be affixed, in the manner indicated in subsection (2), to the fish that has been caught and retained.

5. (1) Subsection 15(3) of the Regulations is replaced by the following:

(3) A person may have dead fish, other than fish of a species set out in Schedule XXVIII, in the person's possession on the waters of Area 7 or 21 or in the portions of Areas 1, 2, 3, 15, 18, 19, 26 and 27 lying on any of Highways 20, 40, 132 (except for the trunk part of Highway 132 between Sainte-Flavie and Matapédia) and 138, or lying between one of those highways and the waters of Area 7 or 21, for use as bait in those waters.

(2) The portion of subsection 15(4) of the Regulations before the table is replaced by the following:

(4) A person may have dead smelt in their possession from December 1 to April 24, in Areas 17 and 28, and may use the dead smelt as bait

(a) in the waters of Area 17 during that period; and

(b) in the waters of Area 28 referred to in the table to this subsection, from December 1 to April 15.

6. The portion of items 5, 8 and 10.02 of the table to section 30 of the Regulations in column I is replaced by the following:

7. Subsection 35(4) of the Regulations is replaced by the following:

(4) For the purposes of subsections (1) to (3), fish caught and retained or, in the case of anadromous Atlantic salmon, caught and released, by a person referred to in paragraph 5(2)(c.1), (c.2) or (d) shall be counted as fish caught by the holder of the licence.

8. Section 40 of the Regulations is replaced by the following:

40. No person shall catch and retain, or have in the person's possession,

(a) an ouananiche measuring less than 40 cm in length taken from the waters of Lake Memphremagog or from the waters of the hydrographic basin of Lake Saint-Jean including the Petite Décharge (48°32'N., 71°37'W.) and the Grande Décharge (48°36'N., 71°40'W.) located upstream from Highway 169, excluding the following waters: Duhamel Lake (49°57'N., 70°54'W.), l'Aventure Lake (50°00'N., 70°52'W.), the Manouane River from the point at 49°56'50"N., 70°45'38"W. to its mouth and the Little Manouane River from the point at 50°06'08"N., 70°52'35"W. to its mouth;

(b) a muskellunge measuring less than 104 cm in length taken from the waters of the St. Lawrence River, Lake Saint-François, Lake Saint-Louis, the Lachine Rapids, the de La Prairie Basin, the des Mille-Îles River, the des Prairies River, Lake des Deux-Montagnes, the portion of the Ottawa River situated in Area 8, or from the waters of Area 25;

(c) a lake trout measuring

(i) 35 cm or more but not more than 50 cm in length taken from the waters set out in any of Schedules I to VI unless the waters are within a wildlife reserve,

(ii) less than 40 cm in length taken from the waters set out in either of Schedules IX and XI or any of Parts I to V of Schedules X, XII to XV and XVIII, unless the waters are located in a wildlife reserve or are referred to in subparagraph (iii), or

(iii) less than 50 cm in length taken from the waters set out below, namely,

(A) Lake Archambault, Lake Blanc (46°19'52"N., 74°12'51"W.) and Lake Ouareau (Area 9) and the Ouareau River between Lake Blanc and Lake Ouareau (46°18'54"N., 74°11'20"W.),

(B) Lake de l'Argile, Blue Sea Lake, Lake du Cerf, Lake Dumont, Lake Gagnon (Preston and Gagnon Townships), Lake Heney, Lake Nominingue, Lake Pemichangan, Petit lac du Cerf Lake, Lake Saint-Germain (46°14'N., 75°30'W.), Thirty-one Mile Lake and the Poisson Blanc Reservoir (Area 10),

(C) Tremblant Lake (Area 11),

(D) Lake Branssat (Forant and Rochefort Townships), Lake Duval (Anjou and Brie Townships) and Lynch Lake (Forant and Rochefort Townships) (Area 12),

(E) Lake Audouin, Lake Grindstone, Lake Hunter, Lake Kipawa, Lake Matchi-Manitou and MacLachlin Lake (Area 13), or

(F) Lake Cousineau (47°01'N., 73°59'W.), Lake Culotte (47°09'N., 74°02'W.), Lake Kempt (47°26'N., 74°16'W.), Lake Légaré (46°58'N., 73°57'W.), Lake Maskinongé, Lake Opwaiak, Lake Saint-Joseph, Lake Troyes and Lake Villiers (47°08'N., 74°02'W.) (Area 15);

(d) a pickerel measuring

(i) less than 45 cm in length taken from the waters of the portion of the Nicolet Sud-Ouest River lying between the downstream side of the first bridge downstream from Les Trois Lacs Lake at Shipton and the downstream side of the bridge on Highway 255 at Wotton, including Les Trois Lacs Lake and the portion of the Nicolet Centre River lying between the mouth of the river and the downstream side of the bridge on Highway 216 at Wotton,

(ii) less than 30 cm in length taken from the waters of the La Vérendrye Wildlife Reserve, the waters of the lands in the domain of the State designated and delineated by Order 493-98 of April 8, 1998, (1998) 130 (G.O.Q., 2, 2335), or the waters in Area 13 or 16, with the exception of the waters set out below, namely,

(A) Abitibi Lake (48°40'N., 79°31'W.) located in Area 13,

(B) the waters of Area 13 lying within the territories leased exclusively for fishing under section 86 of the Act respecting the conservation and development of wildlife, R.S.Q., c. C-61.1, except for the waters lying within the territory leased exclusively for fishing to the Camachigama outfitters described in Schedule 178 to Order 573-87 of April 8, 1987, (1987) 119 (G.O.Q., 2, 2376),

(C) the waters in Area 16 lying within the territory leased exclusively for fishing to the Mistaouac outfitters described in Schedule 112 to Order 573-87 of April 8, 1987, s(1987) 119 (G.O.Q., 2, 2376), as amended by Ministerial Order 2000-027 of August 30, 2000, (2000) 132 (G.O.Q., 2, 5847),

(D) the unnamed lakes in Area 16 located at coordinates 48°59'57"N., 75°00'33"W., 49°09'00"N., 76°08'50"W., 49°09'04"N., 76°22'41"W., 49°09'11"N., 76°32'54"W., 49°09'14"N., 76°35'15"W., 49°09'18"N., 75°42'44"W., 49°12'31"N., 74°56'31"W., 49°12'35"N., 74°53'47"W.,

(E) Lake à l'Eau Rouge, Lake Fauvel, Lake Feuquières, Lake Hébert, Lake Mista Atikamekwranan, Lake Nelson, Lake Némégousse, Lake Podeur, Lake Robert, Lake Valreville (Chambalon Township) and Lake Ventadour, all located in Area 16, and

(F) the waters mentioned in clauses (iii)(A) to (E), or

(iii) less than 35 cm in length taken from the waters set out below, namely,

(A) Jean-Péré Lake (47°04'N., 76°38'W.) located within La Vérendrye Wildlife Reserve,

(B) the waters in the Dumoine Z.E.C.,

(C) the waters in the Kipawa Z.E.C.,

(D) the waters in the Maganasipi Z.E.C.,

(E) the waters in the Restigo Z.E.C., and

(F) the waters of Lake Aylmer, Lake du Huit, Lake à la Truite (Thetford Township) and Lake Saint-François in Area 4, Brompton Lake in Area 6, Grand Lake Nominingue in Area 10, and the waters of the Boullé Z.E.C. and Mitchinamécus Z.E.C. in Area 15; or

(e) a yellow perch measuring less than 16.5 cm in length taken from the waters of the St. Lawrence River or Lake Saint-Pierre lying between the downstream side of the power transmission lines of the Hydro-Québec hydroelectric power station located in Tracy and the downstream side of the Laviolette bridge.

9. Item 2 of Part II of Schedule I to the Regulations is repealed.

10. The portion of subitem 21(2) of Part IV of Schedule I to the Regulations in column I is replaced by the following:

(b) the portion of subitem 11(4) of Part IV of Schedule I in column I;

(c) the portion of subitems 20(3) and (4) of Part IV of Schedule I in column I;

49. (1) The Regulations are amended by replacing the word "Park" with the expression "National Park" wherever it occurs in the following provisions:

(a) subparagraph 15(2.1)(a)(v);

(b) the portion of item 1 of Part II of Schedule XIII in column I;

(c) the portion of item 10 of Part II of Schedule XV in column I; and

(d) the portion of item 12 of Part II of Schedule XV in column I.

(2) The Regulations are amended by replacing, with such modifications as the circumstances require, the expression "the Société" with the expression "the Minister or a Director, as the case may be" wherever it occurs in the following provisions:

FISH TOXICANT REGULATIONS

53. Paragraph 5(b) of the Fish Toxicant Regulations (see footnote 2) is replaced by the following:

ABORIGINAL COMMUNAL FISHING LICENCES REGULATIONS

54. Paragraph (a) of the definition "Minister" in section 2 of the Aboriginal Communal Fishing Licences Regulations (see footnote 3) is replaced by the following:

(a) fisheries for the fish and species of fish described in subsection 3(1) of the Quebec Fishery Regulations, 1990, in the waters referred to in that subsection, the Minister of Natural Resources, Wildlife and Parks of Quebec or the Associate Minister of Forests, Wildlife and Parks for Quebec,

55. These Regulations come into force on the day on which they are registered.

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Description

The Quebec Fishery Regulations (1990) (QFR) are made pursuant to the federal Fisheries Act and control fishing activity in provincial waters for freshwater species and for anadromous and catadromous species (species that live in saltwater and move to freshwater to spawn and species that do the reverse). The province of Quebec through its Ministry of Natural Resources, Wildlife and Parks manages the province's fisheries by agreement with the federal government and has requested the current amendments. The Regulations Amending the Quebec Fishery Regulations, 1990, however, must be processed by the Department of Fisheries and Oceans and approved by the Governor in Council since the regulation-making authority under the Fisheries Act is assigned to the Governor in Council.

Most of the amendments to the QFR are administrative or corrective in nature and will also establish length limits for walleye and brook trout in certain waters and apply an artificial fly restriction in others. The changes are as follows.

1. Administrative area boundary changes

The province of Quebec is currently divided into 29 administrative areas by means of which fishing and hunting activities in the province are managed. Recently, the boundaries of these areas have been changed and four new administrative areas have been created.

In the current QFR, fishing restrictions (quotas, close times, length limits, gear restrictions, etc.) are set out in schedules for each area. As a result of the area boundary adjustments, three of the current regulatory schedules (15, 18 and 19) must be adjusted to take into account the creation of the four new areas. For example, fishing restrictions for certain waters in area 15 are now part of new area 26 or new area 27, certain area 18 waters are now in area 28 and certain area 19 waters are now covered by new area 29.

The necessary regulatory adjustments required by the area boundary changes are administrative in nature and even though there are an extensive number of changes, there is no appreciable change to current fishing restrictions imposed on anglers.

2. Harmonization of provisions for fishing without a licence

In the current QFR, the children of a sport fishing licence holder who are under 18 years of age, or who are students and who are from 18 to 24 years of age, are permitted to fish without a licence for all sport fish species. In addition, the children described above of the spouses or common-law partners of licence holders may also fish without a licence but only for sport fish species other than salmon. For equity's sake, these amendments allows the latter provision to apply to all species of sport fish.

3. Tagging of Anadromous Atlantic Salmon

Currently, a licence to fish for salmon is accompanied by tags and the QFR require anglers to attach these tags in a specified manner to each fish caught (i.e., through the gills of the fish). The province has recently established a new electronic licensing system which will replace the current plastic salmon tags with a licence to which a series of transport coupons are attached in numbered sequence.

As a result, the regulatory provisions governing the method for tagging salmon must be revised. Each time a salmon is caught, anglers will be required to detach a coupon from the licence in sequence and attach that coupon to the fish. The current requirement to leave the coupon attached until the fish is prepared for consumption will remain in effect. However, anglers will no longer be required to attach the coupon to the fish in any specific manner or place.

4. Catch and Release of Salmon

The current QFR state that salmon caught and retained by persons fishing under the licence of another person (e.g., parent or spouse) will be counted as fish caught by the licence holder. In some waters of the province, there are currently quotas applicable to the number of Atlantic salmon that may be caught and released. In order to ensure that applicable catch and release quotas are not exceeded, the QFR will be amended to require that salmon caught and retained, or salmon caught and released by persons fishing under the licence of another person will be counted as fish caught by the licence holder.

5. Waters Restricted to Fly Fishing

In several fishing areas in the province of Quebec, fishing with artificial flies is the only method permitted in certain bodies of water. Restricting angling to the use of artificial flies is an effective means of managing fishing activity in waters where catch limits are already reduced. Since angling with artificial flies can be a difficult skill to master, this restriction also allows for longer fishing seasons in the waters where it applies.

This amendment applies the artificial flies only restriction to three lakes and a section of the du Diable River. This measure has been strongly advocated by people involved in the fishing and tourism industry, concerned with conservation in these areas.

6. Size limit for walleye

Observations have shown that the size of walleye caught by sport fishers in several bodies of water in the Mitchinamecus Controlled Zone (or Z.E.C.) has declined in recent years. This size reduction has been attributed primarily to fishing pressure on fish of optimum reproduction size. Therefore, in the waters of this Z.E.C., anglers will be prohibited from retaining any walleye less than 35 centimetres in length.

This measure will optimize the number of walleye reaching sexual maturity and will improve the size of individual fish. It will also reduce fishing pressure, while permitting the continuation of angling activity upon which many businesses rely. This restriction has been requested by the Association de chasse et pêche Sainte-Anne-du-Lac, which manages the ZEC, and by a great majority of its members.

7. Size limit for brook trout

Similarly, the number of large anadromous brook trout in the Saguenay River and its tributaries has also been affected by sport fishing pressure. While a significant quota reduction already in effect in these waters has helped the situation, the establishment of a size limit on brook trout will further aid the conservation and sustainability of this species. Anglers will be prohibited from retaining brook trout that are more than 39 centimetres in length.

This measure reduces fishing pressure on larger reproductive fish. It will also permit the continuation of sport fishing upon which many area businesses rely.

8. Descriptions changes for northern Quebec salmon rivers

In the Ungava region of northern Quebec, the waters of the Whale, aux Feuilles, Koksoak and George Rivers are designated as salmon rivers. Under the current QFR, specific close times, quotas and gear restrictions apply to fishing in different sections of each of these rivers. Recently, however, discrepancies have been found in the descriptions of the sections of these rivers. These have led to potential overlaps or gaps between river sections which make it difficult for both anglers and enforcement officers to determine which restrictions apply.

For this reason, the current descriptions are being replaced with more accurate, precise descriptions for each section of each river. This will ensure that specific fishing restrictions could be applied in the appropriate areas of these salmon rivers.

9. Minor corrections

A number of administrative, editorial and spelling corrections are also necessary.

  • A reorganization in the province of Quebec has resulted in the creation of a new Ministry of Natural Resources, Wildlife and Parks which is now responsible for fisheries in that province. This change must be reflected in the definition of "Minister" and other provisions of the Quebec Fishery Regulations, 1990. Also, the definition of "Minister" in the Aboriginal Communal Fishing Licences Regulations and the Fish Toxicant Regulations must be changed to reflect the new name of the Quebec Ministry responsible for fisheries management.
  • A change in the province's legislation has redesignated all conservation parks and recreation parks in Quebec as national parks of Quebec. Therefore, the QFR will be amended to change all park names to national parks. For example, all references to Frontenac Recreation Park will be changed to Frontenac National Park.
  • The name of Saint-Agnès Lake has been changed to Nairne Lake and therefore, references in the QFR to the former name are being changed.
  • The incorrect spelling of Urarasujulik Lake is being corrected and certain other errors in close time references and latitude/longitude references in the QFR are being corrected.

Alternatives

The changes referred to in items 1, 8 and 9 are administrative or corrective in nature and no alternative exists that would ensure the clarity, accuracy and precision of the Regulations and the uniformity of their application.

The harmonization of the provisions for fishing without a licence (item 2) is the only equitable alternative. This measure is not only fairer but will be easier to apply and enforce.

The amendment relating to the tagging of anadromous Atlantic salmon (item 3) is the only option that will take into account the tagging system established by the new electronic licensing system.

The adjustment referred to in item 4 is the only measure that will ensure adherence to Atlantic salmon catch and release quotas, even when the fish are caught by someone fishing under the licence of another person.

The application of the artificial fly restriction referred to in item 5 is the best way to further manage fishing activity in the waters specified. It will also improve the sport fishing experience by prolonging the fishing season for anglers already subject to reduced limits.

The establishment of size limits for walleye and brook trout (items 6 and 7) in the waters specified will improve the numbers of fish reaching sexual maturity which will help increase the size of these species. In the specified waters, this amendment will aid improved conservation of these fish species while allowing the continuation of sport fishing and preventing the closure of these fisheries which are important to local area businesses.

Benefits and Costs

While the regulatory adjustments required by the area boundary changes (item 1) are extensive, they are administrative in nature, and as a result will have no appreciable impact on current fishing restrictions or on anglers.

The harmonization of provisions for fishing without a licence (item 2) will be more equitable for young sport fishers and will simplify the enforcement of the Regulations. These amendments will neither incur any additional costs nor reduce revenues for the provincial government.

The changes to salmon tagging provisions (item 3) resulting from the establishment of the licensing system is administrative in nature and will simplify the tagging procedure for anglers.

The amendment referred to in item 4 will ensure adherence to Atlantic salmon catch and release quotas and will have no impact on anglers.

The addition of fly fishing waters (item 5) is intended to improve the sport fishing experience by prolonging the fishing season for anglers already subject to reduced limits. This amendment will also prevent the fishery closures that might otherwise be necessary. These changes will have no financial impact on anglers or on the activities of the tackle shops and other businesses connected with tourism or sport fishing.

The application of size limits for walleye and brook trout (items 6 and 7) will increase the number of walleye that reach sexual maturity. While anglers may have difficulty catching their limit of fish, this measure will prevent the closure of these fisheries which would have much more significant negative impact on both anglers and businesses that rely on sport fishing.

The amendments relating to new salmon river descriptions (item 8) will improve the clarity of the QFR for anglers and for those responsible for enforcing the Regulations. No negative impacts will result from these adjustments.

The remaining amendments (item 9) are administrative in nature and will have no impact on fish stocks, anglers or the provincial government. As well, the new name of the Ministry of Natural Resources, Wildlife and Parks requires amendments to the Aboriginal Communal Fishing Licences Regulations and the Fish Toxicant Regulations as the definitions in the Interpretation Sections of these two Regulations refer to the old name of the Quebec Ministry.

No new enforcement costs are expected as a result of these amendments although some redistribution of effort may be required.

These amendments apply only to recreational fishing and do not apply to aboriginal fishing for food, social, ceremonial or commercial purposes.

Consultation

The Ministry of Natural Resources, Wildlife and Parks of Quebec brings together its principal partners in the wildlife sector by means of an advisory body, the Groupe faune national (National Wildlife Group). This group offers a forum for the discussion and resolution of wildlife issues (including fisheries issues) and an opportunity for principal stakeholders to express their opinions, needs and expectations.

The Groupe faune national is made up of:

  • The Fédération des pourvoyeurs du Québec which represents nearly 400 operators of hunting and fishing lodges that offer services to hunters and fishers as well as to outdoor enthusiasts.
  • The Fédération québécoise de la faune which represents the interests of provincial hunters and fishers.
  • The Fédération québécoise des gestionnaires de ZECS which represents the interests of associations of wildlife managers in Controlled Exploitation Zones or ZECS (zones d'exploitation controllée).
  • The Fédération québécoise pour le saumon atlantique which is a non-profit organization whose objective is the promotion of the conservation, as well as the development and sport fishing of Atlantic salmon.
  • The Société des établissements de plein air du Québec, a Crown corporation whose mission is to ensure the accessibility, development and protection of the tourist facilities for which it is responsible.
  • The Fondation de la faune du Québec, whose mission is to promote conservation and development of wildlife and wildlife habitats.
  • The Fédération des trappeurs gestionnaires du Québec, whose mission is to promote trapping as an economic and professional activity, ensure that trapping is managed, developed and carried on in the future in a way that respects wildlife and wildlife habitats.

This consultative structure carries over to specific areas of the province where regional wildlife groups, where they exist, bring together the regional representatives of these same organizations. In addition, meetings are organized among regional fisheries managers, angling associations, anglers and other interested parties in the various fishery areas of the province to identify areas for improvement and to develop workable solutions.

Solutions requiring regulatory amendments are then forwarded from regional authorities to the Fisheries Regulatory Committee of the Ministry. This Committee is comprised of representatives of the Ministry, from the Wildlife Management and Development, Wildlife Protection, Native Affairs, Wildlife Territories and Regulations branches. In consultation with the regional managers, the Committee analysed all the regulatory proposals, assessing their impact on fishery resources and users, and ensuring regulatory compliance. Consultations with Aboriginal groups are conducted by the Ministry's Aboriginal Affairs Directorate. In this case, no concerns were raised regarding the proposed amendments.

The substantive amendments referred to in items 5, 6 and 7 above were recommended by stakeholders and the public in the areas of the province where the Regulations will apply. The amendments are fully endorsed and supported because they allow a continuation of sport fishing while maintaining healthy, sustainable fisheries. No negative concerns were raised during consultations on these changes or on any of the other administrative or corrective amendments described above.

Compliance and Enforcement

After the amendments have been approved, the public, a variety of tourist and angling associations along with the various partners of the provincial fisheries ministry responsible for the administration of the fisheries will be informed of the changes through press releases and advertisements in a variety of local and regional media. The guides and the brochures of the provincial ministry, entitled La pêche sportive au Québec – principales règles [sport fishing in Quebec – main rules] and La pêche sportive du saumon – principales règles [salmon sport fishing – main rules], clearly set out current regulations and any new regulatory requirements and are widely distributed free of charge throughout the province. These guides and brochures are distributed free of charge in the province. In addition to basic information, these documents provide, for each fishing area, the open seasons and daily catch limits in each fishing area for all sport fish species.

All regulatory information is also available on the Ministry website, which is updated regularly. In addition, a referral and information service has been set up to enable the public to obtain information about the regulations at any time via a 1-800 number or e-mail.

The most heavily used fishing grounds are regularly monitored, and regulatory enforcement personnel provide information about the Regulations, issue warnings in the case of possible violations and bring charges, where necessary. The Fisheries Act provides for penalties of up to 24 months in prison and up to $500,000 in fines for violation of the Regulations. In addition, the courts can order the seizure of gear, catches, vehicles or any other equipment used to commit an offence, and can suspend or revoke licences. These Regulations are enforced by officers of the province of Quebec.
