CULTURAL PROPERTY EXPORT AND IMPORT ACT

Order Amending the Canadian Cultural Property Export Control List

Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, after consultation with the Minister of Foreign Affairs, pursuant to subsection 4(1) (see footnote a) of the Cultural Property Export and Import Act, hereby makes the annexed Order Amending the Canadian Cultural Property Export Control List.

ORDER AMENDING THE CANADIAN CULTURAL PROPERTY EXPORT CONTROL LIST

AMENDMENTS

1. Section 2 of the Canadian Cultural Property Export Control List (see footnote 1) and the heading before it are replaced by the following:

2. This Order applies only to an object that is 50 or more years old and was made by a natural person who is no longer living.

2. The headings before section 1 of Group I of the French version of the List are replaced by the following:

3. (1) The definition "trouvé dans le sol" in section 1 of Group I of the French version of the List is repealed.

(2) The expression "(trouvé dans le sol)" at the end of the definition "recovered from the soil" in section 1 of Group I of the English version of the List is replaced by the expression "(trouvé sur ou dans le sol)".

(3) Section 1 of Group I of the French version of the List is amended by adding the following in alphabetical order:

« trouvé sur ou dans le sol » se dit d'un objet ou d'un spécimen qui provient du sous-sol rocheux ou de la couche sédimentaire, ou y a été trouvé, ou qui a été trouvé à la surface du sol ou de la couche sédimentaire, ou dans la neige ou la glace; (recovered from the soil)

(3) The definition "serial" in section 1 of Group VII of the English version of the List is replaced by the following:

"serial" means a publication that appears at intervals for an indefinite period. (série)

(4) Section 1 of Group VII of the List is amended by adding the following in alphabetical order:

"manuscript, record or document" means textual material in holograph or typescript, excluding printed materials and other works intended for public distribution such as printed books, pamphlets, or serials. Nevertheless, objects considered to be a manuscript, record or document include

(a) a diary, ledger or letterbook;

(b) a literary manuscript;

(c) a leaflet, broadsheet, broadside or poster;

(d) a letter and enclosures;

(e) a cover or sheet that contains postal markings or that incorporates postage or revenue stamps;

(f) a memorandum, report or account;

(g) sheet music;

(h) printed ephemera; and

(i) a single newspaper. (manuscrit, pièce d'archives ou document)

16. The portion of subsection 2(1) of Group VII of the English version of the List before paragraph (a) is replaced by the following:

2. (1) Textual records if they were made in the territory that is now Canada, were made outside that territory by a person who at any time ordinarily resided in that territory, or were made outside that territory and relate to the history or national life of Canada, namely,

19. This Order comes into force on the day on which it is registered.

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Order.)

Description

A review of the Standing Joint Committee for the Scrutiny of Regulations identified a number of minor inconsistencies in the Canadian Cultural Property Export Control List used to identify cultural objects whose export is controlled by the Government of Canada through the issuance of a cultural property export permit.

The Department of Canadian Heritage took advantage of this opportunity to make other amendments to the List that involve semantic alterations to resolve inconsistencies and provide greater clarity.

For example, because they have not been reproduced in the text of the List, the definitions "document", "manuscript" or "record" and "textual record" in section 1 of Group VII of the List have been repealed.

Other amendments include a change to the definition of "livre imprimé ou brochure" in section 1 of Group VII of the French version of the List where the word "réunies" has been replaced by the word "assemblées" to make it consistent with the expression used in the definition of "pièce d'archives cartographiques ou document cartographique" at section 3 of Group VII of the List.

Further amendments are designed to render the French and English versions of the List more consistent. For example, the expression "artefacts that relate to the Aboriginal peoples of Canada" in the English version of the List is now translated by the expression "les objets façonnés se rapportant aux Autochtones du Canada". This new expression replaces the expression previously used "les objets façonnés ayant appartenu aux populations aborigènes du Canada" as it reflects more accurately the intent of the Legislator.

Alternatives

No alternatives were considered since the technical changes are necessary to ensure that the List remains accurate, consistent, and up-to-date.

Benefits and Costs

The benefits of the Regulation to Canadians outweigh its costs because this initiative will incur no costs for the government and will clarify the text of the List for Canadians affected by the legislation.

Consultation

No consultations were undertaken as these amendments are essentially administrative measures that will have no substantive effect on the Canadians affected by this List.

Compliance and Enforcement

The enforcement mechanism in place in the Cultural Property Export and Import Act remains unchanged and provides whomever commits an infraction and is found guilty of an offence:

(a) on summary conviction a fine not exceeding five thousand dollars or to imprisonment for a term not exceeding twelve months or to both; or

(b) on conviction on indictment a fine not exceeding twenty-five thousand dollars or to imprisonment for a term not exceeding five years or to both.
