BROADCASTING ACT

Whereas the Canadian Radio-television and Telecommunications Commission ("the Commission") rendered Broadcasting Decision CRTC 2005-248 on June 16, 2005, which approved the application by CHUM Limited on behalf of a corporation or a partnership to be established (CHUM/Astral), for a broadcasting licence to operate a terrestrial subscription radio undertaking;
Whereas, subsequent to the rendering of the Decision, the Governor in Council received petitions requesting that the Decision be referred back to the Commission for reconsideration and hearing of the matter;
And whereas the Governor in Council, having considered the petitions, is not satisfied that the Decision derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act (see footnote a);
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act (see footnote b), hereby declines to refer Broadcasting Decision CRTC 2005-248 of June 16, 2005 back to the Commission for reconsideration and hearing.
