Regulations Amending Certain Department of Indian Affairs and Northern Development Instruments (Miscellaneous Program)

Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, hereby makes the annexed Regulations Amending Certain Department of Indian Affairs and Northern Development Instruments (Miscellaneous Program), pursuant to

(a) section 57 and subsection 73(3) of the Indian Act;

(b) section 45 of the Northwest Territories Act;

(c) section 18 of the Territorial Lands Act; and

(d) section 98 (see footnote a)  of the Yukon Placer Mining Act and section 14.1 (see footnote b)  of the Yukon Quartz Mining Act.

REGULATIONS AMENDING CERTAIN DEPARTMENT OF INDIAN AFFAIRS AND NORTHERN DEVELOPMENT INSTRUMENTS (MISCELLANEOUS PROGRAM)

INDIAN ACT

Indian Timber Regulations

1. Section 3 of the Indian Timber Regulations (see footnote 1)  is renumbered as subsection 3(1) and is amended by adding the following:

(2) These Regulations do not apply in respect of the cutting of timber on lands to which the Indian Timber Harvesting Regulations apply.

2. Subsection 15(5) of the Northwest Territories Reindeer Regulations (see footnote 2)  is repealed.

Yukon Timber Regulations

3. The definition "zone de récolte prioritaire" in section 2 of the French version of the Yukon Timber Regulations (see footnote 3)  is replaced by the following:

« zone de récolte prioritaire » Emprise routière, carrière, brûlis ou zone d'arbres infestés ou surannés où la partie du peuplement forestier dépérissante ou morte est d'au moins 30 % en nombre de tiges. (priority harvest area)

Order Prohibiting Entry on Certain Lands in the Yukon Territory (1998, No. 10, Tr'ondëk Hwëch'in First Nation, Y.T.)

4. Section 3 of the French version of the Order Prohibiting Entry on Certain Lands in the Yukon Territory (1998, No. 10, Tr'ondëk Hwëch'in First Nation, Y.T.) (see footnote 4)  is replaced by the following:

3. L'article 2 ne s'applique pas au propriétaire ou au détenteur d'un claim d'exploitation de placer ou d'un claim minier enregistré et en règle qui a été acquis en vertu de la Loi sur l'extraction de l'or dans le Yukon ou de la Loi sur l'extraction du quartz dans le Yukon, quant à l'accès à un tel claim.

10. These Regulations come into force on the day on which they are registered.

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Description

These Miscellaneous Amendments Regulations contain amendments to the Northwest Territories Reindeer Regulations and three orders prohibiting entry on certain lands in the Yukon Territory recommended by the Standing Joint Committee for the Scrutiny of Regulations (SJCSR), a very minor correction to the French version of the Yukon Timber Regulations requested by the SJCSR, and an amendment to the Indian Timber Regulations to take into account the new Indian Timber Harvesting Regulations that came into force on February 28, 2002.

The amendments are all of a technical nature. They do not reflect substantive changes to the regulations, but rather make minor non-substantive clarifications and correct inconsistencies between the English and French versions. The amendment to the Northwest Territories Reindeer Regulations addresses a longstanding concern of the SJCSR. It is expected that these changes will have very little or no impact on Canadians.

Miscellaneous Amendments Regulations were developed to streamline the regulatory process and to reduce costs.
