BROADCASTING ACT

Order Declining to Set Aside or to Refer Back to the CRTC Decision CRTC 2002-82

Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 2002-82 on April 8, 2002, which approved an application by Rogers Broadcasting Limited, on behalf of a corporation to be incorporated, for a broadcasting licence to operate a multilingual ethnic television station to serve Toronto, subject to the submission by Rogers Broadcasting Limited to the Commission, within six months after the date of the decision, of an application proposing the use in Toronto of a television channel other than channel 52 and technical parameters that are acceptable to both the Department of Industry and the Commission;

Whereas, subsequent to the rendering of Decision CRTC 2002-82, the Governor in Council has received petitions requesting that the decision be set aside or referred back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing of the matter by the Commission;

And whereas the Governor in Council, having considered the petitions, is not satisfied that Decision CRTC 2002-82 derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act (see footnote a) ;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act (see footnote b) , hereby declines to set aside Decision CRTC 2002-82 of April 8, 2002 or to refer it back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing of the matter by the Commission.
