Notice with respect to Batch 4 Challenge substances — Amendment

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Notice with respect to Batch 4 Challenge substances, published November 17, 2007, in the Canada Gazette, Part I, Vol. 141, No. 46, pp. 3196 to 3214, is amended as set out in Schedule 1. This notice comes into force on the date of its publication.

Amendment

1. Schedule 2 of the notice is amended by adding the following after section 1:

1.1 Despite section 1, this notice does not apply to any person who, during the 2006 calendar year, manufactured, imported, or used hexane (CAS RN (see footnote 1) 110-54-3) in fuel.

2. Section 1 of the Schedule 3 of the notice is amended by adding the following after the definition "calendar year":

"fuel" means any form of matter that is combusted or oxidized for the generation of energy.

Notice No. DGRB-011-07 — Licensing Framework for the Auction for Spectrum Licences for Advanced Wireless Services and other Spectrum in the 2 GHz Range

This notice announces the release of the paper entitled Licensing Framework for the Auction for Spectrum Licences for Advanced Wireless Services and other Spectrum in the 2 GHz Range. This notice and the above-noted paper initiate the licensing process for this spectrum by outlining the rules and requirements for the competitive bidding process established by the Minister and by calling for completed application forms and financial deposits.

On November 28, 2007, the Department released the Policy Framework for the Auction for Spectrum Licences for Advanced Wireless Services and other Spectrum in the 2 GHz Range (Notice No. DGTP-007-07). This paper provides decisions on the key elements of the policy framework for the auction for spectrum in the 2 GHz range, including Advanced Wireless Services.

The Department released its Consultation on proposed conditions of licence to mandate roaming and antenna tower and site sharing and to prohibit exclusive site arrangements (Canada Gazette Notice No. DGRB-010-07), which addresses specific conditions of licence for current licensees with respect to the implementation of measures from the policy framework. Following the close of the supplementary consultation, the final conditions of licence will be made public so that all those affected are aware of the changes prior to the deadline for auction applications.

Notice No. DGRB-012-07 — Update on clarification questions for the AWS Policy Framework and deadline extension for the consultation on proposed conditions of licence (DGRB-010-07)

As in previous auctions, the Department will have a process where questions may be submitted seeking clarification of the auction policy and procedures.

Industry Canada may respond to questions seeking clarification of the Policy Framework for the Auction for Spectrum Licences for Advanced Wireless Services and other Spectrum in the 2 GHz Range (AWS Policy Framework), which was released on November 28, 2007.

The Department may also amend or supplement the licensing rules and procedures that are contained in the soon-to-be-released Licensing Framework for the Auction for Spectrum Licences for Advanced Wireless Services and other Spectrum in the 2 GHz Range (AWS Licensing Framework). This document will be released prior to the end of the year. Any such amendments or supplements will be published on Industry Canada's Spectrum Management and Telecommunications Web site, at http://ic.gc.ca/ spectrumauctions, and will be sent to all qualified bidders.

Written questions asking for clarification of the policy or of the licensing rules or procedures will be accepted until January 22, 2008. Questions received by the deadline, and the Department's written answers, will be published on the Web site.

Such answers will be considered as clarification to the policy set out in the AWS Policy Framework, and as amendments or supplements to the rules and procedures set out in the AWS Licensing Framework.

By way of this notice, the Department is also extending the deadline for the receipt of comments in the Consultation on Proposed Conditions of Licence to Mandate Roaming and Antenna Tower and Site Sharing and to Prohibit Exclusive Site Arrangements (Canada Gazette notice DGRB-010-07) until January 22, 2008. The purpose of this extension is to allow submissions dealing with clarification to the AWS Policy Framework as well as comments to the consultation on the proposed conditions of licence (DGRB-010-07), where the issues raised may be linked.

All submissions received for both processes above will be published on Industry Canada's Spectrum Management and Telecommunications Web site.

Whereas, pursuant to subsection 6.41(1.2) (see footnote a) of the Aeronautics Act (see footnote b), the Minister of Transport, Infrastructure and Communities has consulted with the persons and organizations that the Minister considers appropriate in the circumstances concerning the annexed Interim Order Respecting Prohibited Items;

Therefore, the Minister of Transport, Infrastructure and Communities, pursuant to subsection 6.41(1) (see footnote c) of the Aeronautics Act (see footnote d), hereby makes the annexed Interim Order Respecting Prohibited Items.

INTERIM ORDER RESPECTING
PROHIBITED ITEMS
  INTERPRETATION
Interpretation 1. The definitions in this section apply in this Interim Order.
"general list of prohibited items"

(a) could pose a threat to aviation security;
(b) are prohibited as carry-on baggage by the governments of other countries; or
(c) are identified by the International Civil Aviation Organization as items that must never be carried in the cabin of an aircraft or taken into a restricted area.

Other definitions 2. Unless the context requires otherwise, words and expressions used in this Interim Order have the same meaning as in the Canadian Aviation Security Regulations.
  APPLICATION
CATSA aerodromes 3. This Interim Order applies at aerodromes
listed in the schedule to the CATSA Aerodrome Designation Regulations.
  SCREENING
General list 4. (1) Subject to sections 5 to 8, if an aviation security regulation, a security measure, an emergency direction or an interim order requires a person to be screened, a screening authority shall not permit the person to enter a sterile area unless the screening authority ensures that the person is not in possession or control of goods
(a) that are listed or described in the general list of prohibited items; or
(b) that pose an immediate threat to aviation
security.
Specific list (2) If the sterile area is for passengers for a flight or class of flight listed in the specific list of prohibited items, the screening authority shall not permit the person to enter the area unless the screening authority also ensures that the person is not in possession or control of any goods that are listed or described in that list for the flight or class of flight.
  EXCEPTIONS
Medically necessary goods 5. A screening authority may permit a person in possession or control of goods listed or described in the general list of prohibited items to enter a sterile area if the goods are medically necessary and the person declares them to the screening authority.
Medical kits 6. A screening authority may permit a health care professional in possession or control of a medical kit that contains goods listed or described in the general list of prohibited items to enter a sterile area if the screening authority ensures that the kit does not include sharp or cutting instruments.
Weapons, explosive substances and incendiary devices 7. A screening authority may permit a person in possession or control of a weapon, an explosive substance or an incendiary device to enter a sterile area if the person is carrying it in accordance with the Canadian Aviation Security Regulations.
Liquids, gels and aerosols 8. A screening authority may permit a person in possession or control of liquids, gels or aerosols to enter a sterile area if each liquid, gel or aerosol is in a container that does not exceed 100 mL or 100 g in capacity and all the containers are inside a single clear plastic re-sealable bag that is sealed and does not exceed 1 L in capacity.

EXPLANATORY NOTE

(This note is not part of the Interim Order.)

Liquid explosives continue to pose an immediate threat to aviation security. Since the liquid explosive attack attempts in London in August 2006, the threat has been assessed and addressed on an emergency basis. This Interim Order codifies the present international consensus on how to address the threat and also provides greater transparency with respect to existing regulatory requirements respecting prohibited items. This Interim Order will, in accordance with subsection 6.41(2) of the Aeronautics Act, remain in force for 14 days unless it is approved by the Governor in Council. If so approved, this Interim Order will, in accordance with subsection 6.41(3) of the Aeronautics Act, remain in force for one year or until regulations having the same effect are made in accordance with Canada's regulatory process.

Part 1 of TP 14628, Prohibited Items Lists, lists the following items:

  • ammunition
  • axes and hatchets
  • billiard cues
  • billy clubs and blackjacks
  • bows and arrows
  • box cutters
  • brass knuckles
  • carbon dioxide cartridges and other compressed gases
  • caustic materials (including acids)
  • chemicals or gases that are disabling
  • dangerous goods as defined in section 2 of the Transportation of Dangerous Goods Act, 1992 that are not being transported in accordance with Part 12 of the Transportation of Dangerous Goods Regulations
  • darts
  • devices for shocking
  • firearms and parts of firearms
  • fire extinguishers
  • gas torches
  • golf clubs
  • gun lighters
  • hockey sticks
  • hypodermic needles
  • ice axes and ice picks
  • ice skates
  • insecticides
  • knives or knife-like objects of any length
  • lacrosse sticks
  • liquids, gels or aerosols — other than formula, milk, juice or food for infants
  • martial arts devices
  • oxygen tanks
  • penetrating objects
  • pyrotechnics
  • razor blades
  • replica weapons
  • restraining devices
  • scuba tanks
  • ski poles
  • sling shots and catapults
  • sporting bats
  • tools
  • toy weapons including toy transformer robots that form into toy guns

Part 2 of TP 14628, Prohibited Items Lists, lists flights to the United States from aerodromes that have U.S. preclearance facilities. In respect of these flights, lighters are also prohibited items.

Travellers are advised that TP 14628, Prohibited Items Lists, is subject to change. The current version is posted on www.tc. gc.ca and may also be obtained by contacting the Department of Transport.
