Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-03392 is approved.

1. Permittee: Fraser River Pile & Dredge Ltd., New Westminster, British Columbia.

2. Type of Permit: To load waste and other matter for the purpose of disposal at sea and to dispose of waste and other matter at sea.

3. Term of Permit: Permit is valid from July 31, 2006, to July 30, 2007.

4. Loading Site(s): Richmond Plywood, New Westminster, British Columbia, at approximately 49°12.17' N, 123°04.25' W.

5. Disposal Site(s): Point Grey Disposal Site: 49°15.40' N, 123°22.10' W, at a depth of not less than 210 m.

The following position-fixing procedures must be followed to ensure disposal at the designated disposal site:

(i) The vessel must inform the appropriate Marine Communications and Traffic Services (MCTS) Centre upon departure from the loading site that it is heading for a disposal site;

(ii) Upon arrival at a disposal site and prior to disposal, the vessel must again call the appropriate MCTS Centre to confirm its position. Disposal may proceed if the vessel is on the designated site. If the vessel is not within the disposal site boundaries, the MCTS Centre will direct it to the site and advise when disposal may proceed; and

(iii) The vessel must inform the appropriate MCTS Centre when disposal has been completed prior to leaving the disposal site.

6. Route to Disposal Site(s): Direct.

7. Method of Loading and Disposal: Loading by clamshell dredge with disposal by bottom dump scow or end dumping.

8. Rate of Disposal: As required by normal operations.

9. Total Quantity to Be Disposed of: Not to exceed 12 000 m³.

10. Waste and Other Matter to Be Disposed of: Dredged material consisting of silt, sand, rock, wood waste and other approved material typical to the approved loading site, except logs and usable wood.

10.1. The Permittee must ensure that every reasonable effort has been made to prevent the deposition of log bundling strand into material approved for loading and disposal at sea and/or remove log bundling strand from material approved for loading and disposal at sea.

11. Requirements and Restrictions:

11.1. The Permittee must notify the permit-issuing office before commencement of the project as to the dates on which the loading and disposal at sea will occur.

11.2. The Permittee must ensure that all contractors involved in the loading or disposal activity for which the permit is issued are made aware of any restrictions or conditions identified in the permit and of the possible consequences of any violation of these conditions. A copy of the permit and of the letter of transmittal must be displayed at the loading site and carried on all towing vessels and loading platforms or equipment involved in disposal at sea activities.

11.3. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

11.4. Contact must be made with the Canadian Coast Guard, Regional Marine Information Centre, regarding the issuance of a "Notice to Shipping." The Regional Marine Information Centre is located at 2380–555 West Hastings Street, Vancouver, British Columbia V6B 5G3, (604) 666-6012 (telephone), (604) 666-8453 (fax), or rmic-pacific@pac.dfo-mpo.gc.ca (email).

11.5. Any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999 shall be permitted to mount an electronic tracking device on any vessel that is engaged in the disposal at sea activities authorized by this permit. The Permittee shall take all reasonable measures to ensure that there is no tampering with the tracking device and no interference with its operation. The tracking device shall be removed only by an enforcement officer or by a person with the written consent of an enforcement officer.

11.6. The Permittee must submit to the Regional Director, Environmental Protection Operations Directorate, within 30 days of the expiry of the permit, a list of all work completed pursuant to the permit, the nature and quantity of material disposed of and the dates on which the activity occurred.

1. Permittee: Petro-Canada, St. John's, Newfoundland and Labrador.

2. Type of Permit: To load and dispose of a ship, aircraft, platform or other structure at sea.

3. Term of Permit: Permit is valid from August 14, 2006, to August 13, 2007.

4. Loading Site(s): Northeast site: 46°30.65' N, 48°28.23' W; or Southwest site: 46°26.38' N, 48°29.20' W, Terra Nova Oil Field, Newfoundland and Labrador.

5. Disposal Site(s): Northeast site: 46°30.65' N, 48°28.23' W; or Southwest site: 46°26.38' N, 48°29.20' W, Terra Nova Oil Field, Newfoundland and Labrador, at a depth of 100 m.

6. Route to Disposal Site(s): Most direct navigational route from the loading site to the disposal site.

7. Equipment: The Terra Nova FPSO (Floating Production, Storage and Offloading) vessel will be using on-board winches.

8. Method of Disposal: The bottom plate will be detached from the Terra Nova FPSO at the disposal site and lowered to the seabed using on-board winches.

9. Total Quantity to Be Disposed of: 190 metric tonnes.

10. Waste and Other Matter to Be Disposed of: The steel bottom plate from the Terra Nova FPSO. This plate measures 17 m in diameter and 2.73 m in height.

11. Requirements and Restrictions:

11.1. It is required that the Permittee report, in writing, to Mr. Rick Wadman, Environmental Protection Operations Directorate, Environment Canada, 6 Bruce Street, Mount Pearl, Newfoundland and Labrador A1N 4T3, (709) 772-5097 (fax), rick.wadman@ec.gc.ca (email), at least 48 hours prior to the start of the disposal operation to be conducted under this permit.

11.2. A written report shall be submitted to Mr. Rick Wadman, identified in paragraph 11.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the dates on which the loading and disposal activities occurred and the final position and orientation of the plate.

11.3. It is required that the Permittee admit any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999 to any place, ship, or anthropogenic structure directly related to the loading or disposal at sea referred to under this permit, at any reasonable time throughout the duration of this permit.

11.4. It is required that the Permittee report to the Section Head, Habitat Planning and Operations, Department of Fisheries and Oceans, St. John's, Newfoundland and Labrador, at least 48 hours prior to the start of the disposal operation to be conducted under this permit.

11.5. The Permittee shall conduct a videographic survey of the disposal site within 30 days of disposal. The results shall be provided in a digital format to Mr. Rick Wadman, identified in paragraph 11.1, within 30 days of the completion of the survey.

11.6. It is required that the Permittee report to Mr. Gary Smith, Sailing Direction Officer, Department of Fisheries and Oceans, P.O. Box 5667, St. John's, Newfoundland and Labrador A1C 5X1, (709) 772-0448, and provide final coordinates of the plate.

11.7. The Permittee shall contact Marine Communications and Traffic Services, (709) 772-2083, and provide details of the disposal operation at least 96 hours prior to the planned departure. As soon as possible after the plate is in its final position, the coordinates of the plate and the time of disposal shall be reported to Marine Communications and Traffic Services.

11.8. The loading or disposal at sea conducted under this permit shall not be carried out without written authorization from the Permittee.

Whereas perfluorooctane sulfonate (PFOS) ammonium salt (CAS 29081-56-9), PFOS potassium salt (CAS 2795-39-3) and PFOS diethanolamine salt (CAS 70225-14-8) are substances on the Domestic Substances List categorized pursuant to subsection 73(1)(b) of the Canadian Environmental Protection Act, 1999,

Whereas a summary of the assessment of PFOS, its salts and its precursors, compounds that contain one of the following groups: C₈F₁₇SO₂, C₈F₁₇SO₃or C₈F₁₇SO₂N, conducted pursuant to paragraph 74(a) is annexed hereby, and

Whereas it has been concluded that perfluorooctane sulfonate and its salts meet the criterion set out under paragraph 64(a) of the Canadian Environmental Protection Act, 1999,

Notice therefore is hereby given that the Ministers of the Environment and of Health propose to recommend to Her Excellency the Governor in Council that perfluorooctane sulfonate and its salts be added to Schedule 1 to the Canadian Environmental Protection Act, 1999.

Notice therefore is further given that consultations will be held on the development of a regulation or instrument respecting preventive or control action in relation to the said substances.

EXPLANATORY NOTE

Interpretation of Bioaccumulation Information for PFOS, its Salts and its Precursors, Compounds that Contain One of the Following Groups: C₈F₁₇SO₂, C₈F₁₇SO₃or C₈F₁₇SO₂N In Accordance with the Persistence and Bioaccumulation Regulations

The information presented below outlines how the bioaccumulation potential for PFOS and its salts was assessed against the Persistence and Bioaccumulation Regulations under the Canadian Environmental Protection Act, 1999 (CEPA 1999).

PFOS has been detected in many wildlife species worldwide. Field evidence identifies high concentrations of PFOS accumulating in the liver and blood of fish-eating mammals and birds in the Canadian Arctic, far from known sources or manufacturing facilities. PFOS concentrations in polar bears are higher than any other previously reported concentrations of other persistent and bioaccumulative chemicals such as PCBs, chlordane, and hexachlorocyclohexane.

Data on two key field-based measures for bioaccumulation, that is, magnification up the food chain and in specific animal tissues, reflect existing environmental conditions and support the conclusion that PFOS bioaccumulates in organisms and biomagnifies in aquatic, terrestrial, and avian species in both freshwater and Canadian Arctic food chains. However, these measures are not specified as criteria in the Persistence and Bioaccumulation Regulations.

The bioaccumulation criteria in the Regulations have been developed based primarily on data for fish and assumptions relevant to substances which accumulate in lipids. Values from available laboratory studies on PFOS directly comparable to the numeric criteria for bioaccumulation in the Regulations are below those values. PFOS, however, accumulates to a greater degree in mammals and fish-eating birds and primarily in proteins in liver and blood. Hence, from a screening assessment perspective, fish are not considered to be the most relevant organism to estimate the bioaccumulation potential of PFOS in ecosystems.

While there is scientific evidence that PFOS is a persistent organic pollutant that accumulates in animals and magnifies in food chains, PFOS does not meet the numeric criteria for bioaccumulation defined in the Persistence and Bioaccumulation Regulations and does not meet the conditions set out under subsection 77(4) of CEPA 1999 for mandatory addition to the Virtual Elimination list.

Summary of the Screening Assessment of Perfluorooctane Sulfonate, its Salts and its Precursors, Compounds that Contain One of the Following Groups: C₈F₁₇SO₂, C₈F₁₇SO₃or C₈F₁₇SO₂N

Perfluorooctane sulfonate (PFOS), its salts and its precursors form part of a larger chemical class of fluorochemicals referred to as perfluorinated alkyl (PFA) compounds. The term PFOS may refer to any of its anionic, acid or salt forms. The perfluorooctylsulfonyl (C₈F₁₇SO₂ or C₈F₁₇SO_3,or C₈F₁₇SO₂N) moiety is incorporated in a variety of compounds which have the potential to transform or degrade to PFOS in the environment. For the purpose of this assessment, the term "precursor" refers to compounds that contain the C₈F₁₇SO₂ or C₈F₁₇SO₃,or C₈F₁₇SO₂N moiety and, therefore, have the potential to transform or degrade to PFOS. The term "precursor" applies to, but is not limited to, some 50 substances identified in the ecological assessment. This assessment addresses PFOS and also considers its precursors, given their similar use applications and given that PFOS is the final degradation product of PFOS precursors. While the assessment did not consider the additive effects of PFOS and its precursors, it is recognized that the precursors to PFOS contribute to the ultimate environmental loadings of PFOS. Precursors may also play a key role in the long-range transport and subsequent degradation to PFOS in remote areas. PFOS is considered persistent and is not known to undergo any further chemical, microbial or photolytic degradation.

PFOS is of anthropogenic origin with no known natural sources. In Canada, there is no known manufacture of perfluorinated alkyl compounds, including PFOS. Approximately 600 tonnes of perfluorinated alkyl compounds were imported into Canada between 1997 and 2000. While PFOS represents a very small proportion of this total (<2%), PFOS and its precursors accounted for about 43%. The principal applications for PFOS and its precursors are water, oil, soil and grease repellents for use on surface and paper-based applications, such as rugs and carpets, fabric and upholstery and food packaging. PFOS and its precursors also have specialized chemical applications, such as fire-fighting foams, hydraulic fluids, carpet spot removers, mining and oil well surfactants and other specialized chemical formulations.

Environment

Exposure in the Canadian environment would likely result from the release, transformation and movement of PFOS and its precursors in effluents and fugitive emissions from manufacturing sites elsewhere in the world, and releases in Canadian industrial and municipal wastewater effluents.

PFOS is resistant to hydrolysis, photolysis, microbial degradation, and metabolism by vertebrates. PFOS has been detected in fish and wildlife sampled worldwide. This includes Canadian wildlife located far from known sources or manufacturing facilities indicating that PFOS and/or its precursors may undergo long-range transport. Maximum concentrations in liver of biota in remote areas of the Canadian Arctic include mink (20 µg.kg^-1), common loon (26 µg.kg^-1), ringed seal (37 µg.kg^-1), brook trout (50 µg.kg^-1), Arctic fox (1 400 µg.kg^-1) and polar bear (>4 000 µg.kg^-1).

Unlike many other persistent organic pollutants, certain perfluorinated substances, such as PFOS, are present as ions in environmental media and partition preferentially to liver and blood rather than lipids. The log K_ow is not calculable for PFOS. Therefore, the bioaccumulation potential of PFOS may not be related to the typical mechanisms associated with bioaccumulation in lipid-rich tissues.

Whole-body freshwater aquatic bioconcentration factors (BCFs) and bioaccumulation factors (BAFs) for PFOS are below 5 000. Estimated steady-state PFOS BCF of 1 100 (carcass), 5 400 (liver) and 4 300 (blood) have been reported for juvenile rainbow trout. The corresponding 12-day accumulation ratios were 690 (carcass), 3 100 (blood), and 2 900 (liver). Model-estimated BCFs for the precursors, n-EtFOSEA and n-MeFOSEA, were 5 543 and 26 000, respectively. In fish livers collected from 23 different species in Japan, BAFs were calculated to range from 274– 41 600. Following an accidental release of fire-fighting foam, fish liver BAFs were calculated in the range of 6 300–125 000. Species differences for the elimination half-life of PFOS in biota have been determined to vary significantly: 15 days (fish), 100 days (rats), 200 days (monkeys) and years for humans. However, elimination through the gills is an important route for fish which is not available to birds, terrestrial mammals (e.g. mink, polar bear, Arctic foxes) and marine mammals (e.g. seals and whales). There are three studies suggesting that PFOS biomagnifies in the Great Lakes and Arctic food webs. For a Great Lakes multi-trophic food chain, a biomagnification factor (BMF) of 10 to 20 was calculated in mink and bald eagles. In another Great Lakes food chain, a multi-trophic level BMF of 5.88 was determined for lake trout. PFOS may biomagnify through Arctic marine food webs. The BMF for PFOS for a number of species (e.g. narwhal, beluga, cod, redfish, glaucous gull, and zooplankton) ranged from 0.4 to 9.0. PFOS is concluded to be a bioaccumulative substance, taking into account the intrinsic properties of the substance, the ecosystem under consideration, the conditions in the environment, and both field- and laboratory-derived whole body and tissue-specific BCFs, BAFs, and BMFs.

Based on available toxicity tests, estimated no-effect levels were determined for fish, birds (liver), bird (serum), and wildlife (0.491 µg.L^-1, 0.609 µg.g^-1, 0.873 µg.mL^-1 and 0.408 µg.g^-1, respectively). The resulting risk quotients for fish, a range of bird species (liver), a range of bird species (serum), and wildlife were 0.25, 0.002 to 2.92, 0.43 to 2.54 and 9.2, respectively. Therefore, current levels show that some wildlife organisms (e.g. polar bear, bird species) could be near or at effect levels and could be harmed by current exposures to PFOS.

The assessment is based on a weight of evidence approach regarding persistence, bioaccumulation, PFOS concentrations in the environment and in biota (including remote areas of Canada), and risk quotient analyses. Based on available data, it is concluded that PFOS, its salts and its precursors are entering the environment in a quantity or concentration or under conditions that have or may have an immediate or long-term harmful effect on the environment or its biological diversity. In addition, based on available data, it is concluded that PFOS and its salts meet the criteria for persistence in the Persistence and Bioaccumulation Regulations. The weight of evidence is also sufficient to conclude that PFOS and its salts are bioaccumulative.

Human health

Margins of exposure in the screening health assessment were based on comparison of the mean levels of PFOS in the serum and liver of animals at the critical effect level in a chronic study in rats and a 26-week study in monkeys and either mean or 95th percentile levels in serum and/or liver from biomonitoring studies in humans (adults and children).

These margins range between 143 and 2 170 and are considered adequate to address elements of uncertainty, including intra-species variation, interspecies variation and biological adversity or severity of the effects considered critical here. These margins will also be protective for the increased incidence of tumours observed in the chronic study of PFOS in rats, since the tumours were observed only at doses of PFOS that were higher than those that induced non-neoplastic effects and since the weight of evidence indicates that PFOS (and precursors) are not genotoxic. While the margins for blood levels in children are somewhat less (approximately 145 for the 95th-percentile values), more appropriate margins for comparison with the effect level from long-term studies are those for adults (approximately 225 for the 95th-percentile values), since they are exposed for a greater portion of their life span. In addition, the critical lowest-observed-effect levels selected for development of these margins of exposure are very conservative, being about an order of magnitude less than values in other studies (i.e. for effects observed in reproductive studies with rats). The margins are also based on more relevant metrics of exposure to PFOS than dose in experimental studies and deterministic estimates of daily intake in children and adults and, as a result, account for a significant portion of the uncertainties associated with interspecies and intraspecies differences in pharmacokinetics (usually accounted for by 4-fold and 3.2-fold default uncertainty factors, respectively). The higher margins for values in liver, although based on limited data, take into account even a greater proportion of uncertainty in toxicokinetics. The margins also take into account limitations of the database for human exposure. Use of the 95th percentiles for the serum levels is also more conservative than deterministic estimates of exposure, which are based on mean intakes of environmental media.

Conclusion

Based on available information for ecological considerations, it is concluded that PFOS, its salts, and compounds that contain one of the following groups: C₈F₁₇SO₂, C₈F₁₇SO₃or C₈F₁₇SO₂N meet the criterion set out in paragraph 64(a) of CEPA 1999.

Summary of the Screening Assessment of Polybrominated Diphenyl Ethers

Pursuant to paragraph 74(a) of the Canadian Environmental Protection Act, 1999, the Ministers of the Environment and of Health have conducted a screening assessment on polybrominated diphenyl ethers, CAS numbers 40088-47-9, 32534-81-9, 36483-60-0, 68928-80-3, 32536-52-0, 63936-56-1 and 1163-19-5.

Polybrominated diphenyl ethers (PBDEs) are a class of substances which contain an identical base structure but differ in the number of attached bromine atoms (n=1 to 10). Of the ten isomer groups, seven are on the Domestic Substances List and are considered in this assessment, including tetra– to decabromodiphenyl ethers (tetra– to decaBDEs). PBDEs are generally present in the form of mixtures, referred to as commercial pentabromodiphenyl ether (PeBDE) (which is predominately a mixture of penta–, tetra–, and hexaBDE(, commercial octabromodiphenyl ether (OBDE) (which contains mainly hepta–, octa–, and hexaBDE but may also contain small amounts of nona– and decaBDE( and commercial decabromodiphenyl ether (of which current formulations are almost entirely decaBDE with a small amount of nonaBDE). PBDEs are used in Canada as additive flame retardants in a wide variety of consumer products, including internal electric/electronic components of and casings for household appliances/electronics (e.g. hair dryers, televisions, computers), furniture upholstery and cushioning, and wire and cable insulation.

The identical base structure and combinations of congeners within the different commercial mixtures support consideration of a category approach to assessment of these compounds. In addition, to the extent that the data permit comparison, consideration of these compounds as a group is supported by trends in physical/ chemical properties with increasing degree of bromination.

Results from a section 71 Notice with Respect to Certain Substances on the Domestic Substances List (DSL) conducted for the year 2000 indicated that no PBDEs were manufactured in Canada, although approximately 1 300 tonnes of PBDE commercial products were imported into the country. Based on quantities reported, commercial pentabromodiphenyl ether was imported in the greatest volume followed by commercial decabromodiphenyl ether and commercial octabromodiphenyl ether.

Various initiatives have resulted in significant changes in the production and use of PBDEs since 2000. The only U.S. manufacturer of PeBDE and OBDE, Great Lakes Chemical Corporation, voluntarily ceased its production of these products late in 2004. ICL Industrial Products also announced that they would completely terminate their production and sale of OBDE by the end of 2004. In addition, the European Union has implemented a prohibition on the marketing and use of PeBDE and OBDE in products effective August 15, 2004. While it is expected that these actions have resulted in significant changes in the global and Canadian use of PBDEs, many products currently in use will have been manufactured during or before 2004 using PeBDE and OBDE.

Environment

PBDEs may be released to the environment during manufacturing and polymer processing operations, throughout the service life of articles containing them, and at the end of article service life during disposal operations. With their low vapour pressures, low water solubility and high log Kow values, it is expected that PBDEs entering the environment will tend to bind to the organic fraction of particulate matter, notably in sediment and soils, with only small amounts partitioning into water and air.

Empirical and predicted data indicate that all PBDEs under consideration are highly persistent and are subject to long-range transport, and each satisfies the requirements for persistence as defined by the CEPA 1999 Persistence and Bioaccumulation Regulations. Although considered persistent, evidence suggests that PBDEs may be susceptible to some degree of metabolic transformation, photodegradation, aerobic biodegradation and reaction with reducing agents under certain circumstances. Studies have shown the transformation of higher brominated PBDEs (e.g. hepta– to decaBDEs) to lower brominated congeners (e.g. congeners of tetraBDE, pentaBDE and hexaBDE) which are likely to be more bioaccumulative than the parent compound could be considered persistent and may be directly toxic to organisms. The degree to which these processes affect the overall risk to the environment from tetra– to hexaBDEs is not clear.

PBDEs have been detected in a variety of species worldwide, and evidence from many studies indicates that their levels in biota in North America (including the Canadian Arctic) are increasing steadily and even substantially over time.

Measured data indicate that tetra–, penta– and hexaBDEs are highly bioaccumulative and satisfy the criteria for bioaccumulation as described in the CEPA 1999 Persistence and Bioaccumulation Regulations. A low level of uptake of heptaBDEs and decaBDE in biota is demonstrated by their measured accumulation in the tissues of wild fish, mammals and/or bird eggs. There is a weight of evidence suggesting that highly brominated PBDEs such as octa– and decaBDE are precursors of the more toxic, bioaccumulative and persistent lower brominated PBDEs.

Risk quotient analyses, integrating known or potential exposures with known or potential adverse environmental effects, were performed for each of the three commercial PBDE products subject to this assessment. The results indicate that the greatest potential for risk from PBDEs in the Canadian environment is due to the secondary poisoning of wildlife from the consumption of prey containing elevated concentrations of congeners from commercial penta– and octabromodiphenyl ethers. Elevated concentrations of components of commercial pentabromodiphenyl ether in sediments may present risk to benthic organisms. HexaBDE is a component of both commercial penta– and commercial octabromodiphenyl ethers and could be a product of hepta– to decaBDE transformation. Therefore, risks associated with congeners found in commercial pentabromodiphenyl ether may also be due to the release of commercial octabromodiphenyl ether, and could be due to the debromination of highly brominated PBDEs found in commercial decabromodiphenyl ether. The risk analyses for soil organisms indicate that risk quotients were below one for commercial penta–, octa and decabromodiphenyl ethers, although there is considerable uncertainty given the lack of data characterizing PBDE concentrations in soil and sewage sludge applied to soil. The PBDEs would present a low potential for risk due to direct toxicity to pelagic organisms. In the water column, risk associated with tetra–, penta– and hexaBDE congeners may be due to bioaccumulation and toxicity to secondary consumers.

There is a lack of data characterizing the toxicity of PBDEs to wildlife. Recent studies using rodents provide evidence that exposure to PBDEs may lead to behavioural disturbances, disruptions in normal thyroid hormone activity and liver effects.

The PBDEs subject to this assessment have low vapour pressures and Henry's Law constants and are not expected to partition significantly into the atmosphere. As such, they are considered to present a negligible risk with respect to atmospheric processes such as global warming, stratospheric ozone depletion and ground-level ozone formation.

Pyrolysis and extreme heating can cause all PBDEs to form brominated dibenzo-p-dioxins and dibenzofurans. These transformation products are considered to be brominated analogues of the Government of Canada Toxic Substances Management Policy (TSMP) Track 1 substances polychlorinated dibenzo-p-dioxins and dibenzofurans. Brominated dibenzofurans may also be formed to some degree from the phototransformation of decaBDE.

Available data indicate the potential for exposure of organisms to PBDEs at concentrations of concern. Although concentrations of homologues from commercial decabromodiphenyl ether may not currently exceed known effect thresholds, those homologues are persistent. In addition, it is reasonable to consider that the transformation of highly brominated diphenyl ethers could contribute to the formation of at least some amount of lower brominated diphenyl ethers and dibenzofurans over the long term. The long-range transport of some PBDEs has resulted in their widespread occurrence, including in remote regions. The persistent and bioaccumulative character of these substances can lead to prolonged exposure and potential accumulation in organisms. Field evidence indicates increasing concentrations in organisms over time.

Based on this evidence, it is concluded that PBDEs, including tetraBDEs, pentaBDEs, hexaBDEs, heptaBDEs, octaBDEs, nonaBDEs and decaBDEs, which are found in commercial penta–, octa–, and decabromodiphenyl ethers, are entering the environment in a quantity or concentration or under conditions that have or may have an immediate or long-term harmful effect on the environment or its biological diversity and have been determined to be met under paragraph 64(a) of CEPA 1999.

Human health

Critical targets for PBDE-induced health effects reported for the various congeners and commercial mixtures are similar. As a result, the critical effect level considered most appropriate for assessment of risk to human health for this group of PBDEs in a screening context is the conservative value of 0.8 mg/kg-bw/day (for pentabromodiphenyl ether). This is based on neurobehavioural effects which were dose and time related observed in neonatal mice administered a single oral dose by gavage on post-natal day 10 and observed for a subsequent five month period.

Comparison of the critical effect level (i.e. 0.8 mg/kg-bw) to the upper bounding estimate of exposure for the total intake of all PBDEs for the potentially most highly exposed age group (2.6 µg/kg-bw/day in breast-fed infants) results in a margin of exposure of approximately 300. The selected critical effect level and deterministic estimates of exposure are considered quite conservative, consistent with the objective of screening health assessments.

The conservative nature of the margin of exposure does not, however, take into account the potential continuing increase in body burden of PBDEs (based on data for breast milk), should similar use patterns continue. Prediction of trends in body burdens is precluded by the limited relevant information. This includes lack of information on the behaviour of PBDEs in human blood and tissue and transfer from human breast milk to infants, as well as the uncertainty in timeframes for removal processes for PBDEs in environmental media. Determination of the adequacy of this margin to address elements of uncertainty associated with limitations of the database for health effects and population exposure (in which confidence overall is considered to be moderate), intraspecies and interspecies variations in sensitivity, as well as the biological adversity or severity of the effects deemed critical requires additional in-depth evaluation of the relevant data. It also requires development of additional, more meaningful information on population exposure to PBDEs.

However, in view of the proposed recommendation to add PBDEs to Schedule I of CEPA 1999, based on environmental considerations, more in-depth evaluation of PBDEs from a human health perspective is considered a low priority, unless information becomes available to indicate that measures recommended to control exposure of environmental organisms to PBDEs will not be protective for human health. This priority is based on the smaller margin between the most conservative estimated critical values for exposure and effects on the environment in comparison with that for human health (approximately 7 (see footnote 1) versus 300) and experience in other countries that risk management actions to protect the environment have resulted in a reduction of exposure of humans.

Geographical indications

The Minister of Industry proposes that the following geographical indications be entered on the list of geographical indications kept pursuant to subsection 11.12(1) of the Trade-marks Act, where: "(i)" refers to the file number, "(ii)" refers to the indication and whether it identifies a wine or spirit, "(iii)" refers to the territory, or the region or locality of a territory in which the wine or spirit is identified as originating, "(iv)" refers to the name of the responsible authority (the person, firm or other entity that is, by reason of state or commercial interest, sufficiently connected with and knowledgeable of the wine of spirit), "(v)" refers to the address in Canada for the responsible authority, and "(vi)" refers to the quality, reputation or other characteristic of the wine or spirit that, in the opinion of the Minister, qualifies that indication as a geographical indication:
