Notice is hereby given that the Canadian International Trade Tribunal made a decision on April 6, 2006, with respect to an appeal filed by Norsk Fitness Products Inc. from a decision of the Commissioner of the Canada Customs and Revenue Agency dated October 23 and 28, 2003, with respect to a request for re-determination under subsection 60(4) of the Customs Act.

The appeal, heard on November 8, 2005, under section 67 of the Customs Act, was allowed in part.

ORDER

Leather footwear with metal toe caps

In the matter of a notice of expiry, pursuant to subsection 76.03(2) of the Special Import Measures Act, of the finding made by the Canadian International Trade Tribunal on December 27, 2001, in Inquiry No. NQ-2001-003, concerning leather footwear with metal toe caps originating in or exported from the People's Republic of China, excluding waterproof footwear subject to the finding made by the Canadian International Trade Tribunal in Inquiry No. NQ-2000-004, continued in Expiry Review No. RR-2004-008

On February 21, 2006, the Canadian International Trade Tribunal issued a notice of expiry (Expiry No. LE-2005-005) requesting submissions on whether it should initiate an expiry review in the above-mentioned matter. Upon examination of all arguments and evidence presented by parties that filed submissions, the Canadian International Trade Tribunal is not satisfied that an expiry review is warranted and, pursuant to subsection 76.03(5) of the Special Import Measures Act, has therefore decided not to initiate an expiry review.

PUBLIC NOTICE 2006-47

Regulatory framework for mobile television broadcasting services

In the notice, the Commission announces its determination that the mobile television broadcasting services described therein and operated by Bell Mobility Inc., TELUS Mobility and Rogers Wireless Inc., in conjunction with MobiTV Inc., fall within the New Media Exemption Order because they are "delivered and accessed over the Internet." In a separate notice issued today, the Commission has also called for comments on a proposed new exemption order that will include mobile television broadcasting undertakings that provide mobile television services that are not delivered and accessed over the Internet.
