Compliance agreement

This notice is published by the Commissioner of Canada Elections, pursuant to section 521 of the Canada Elections Act, S.C. 2000, c. 9.

On January 26, 2006, the Commissioner of Canada Elections entered into a compliance agreement with NorTerra Inc. (hereinafter referred to as the Contracting Party), of the city of Edmonton, province of Alberta, Canada, pursuant to section 517 of the Canada Elections Act.

The Contracting Party has acknowledged having contravened section 404.1 of the Canada Elections Act, when three corporations in the NorTerra group of companies exceeded the contribution limits set out in the Act by $2,821.76, by failing to take into account the definition of "corporation" contained in subsection 404.1(2) of the Act.

Prior to the conclusion of the agreement, the Commissioner of Canada Elections took into account that

  • the Contracting Party acknowledged exceeding the contribution limits set out in the Act for corporations;
  • the Contracting Party has put in place a procedure to ensure that in future, the total of all contributions made by corporations within the NorTerra group of companies, which fall within the definition of "corporation" contained in subsection 404.1(2) of the Act, does not exceed the limits set by section 404.1 of the Act; and
  • the Contracting Party acknowledged that any contribution in excess of the limits set out in section 404.1 of the Act cannot be claimed as a federal political contribution tax credit.
