Food and Drug Regulations — Amendment
Interim Marketing Authorization
Provision currently exists in Table V to section B.16.100 of the Food and Drug Regulations for the use of the enzyme lipase derived from both conventional and genetically modified micro-organisms in the production of bread, flour, unstandardized bakery products, and edible fats and oils at levels consistent with good manufacturing practice. The permitted sources of the lipase enzyme include the micro-organisms Aspergillus niger and Aspergillus oryzae.
Health Canada has received a submission to permit the use of the lipase enzyme obtained from a genetically modified Aspergillus oryzae organism, Aspergillus oryzae (MStr115), that carries the gene from Fusarium oxysporum coding for this enzyme, in the production of bread, flour, unstandardized bakery products and in egg yolk modification and lecithin hydrolysis. Evaluation of available data supports the safety and effectiveness of this lipase obtained from the genetically modified Aspergillus oryzae (MStr115).
The use of the lipase enzyme obtained from this modified micro-organism will benefit the consumer through the availability of quality food products. It will also benefit industry through more efficient and improved manufacturing conditions.
Therefore, it is the intention of Health Canada to recommend that the Food and Drug Regulations be amended to permit the use of this lipase enzyme obtained from the micro-organism specified above in the production of bread, flour and unstandardized bakery products, in whole egg/egg yolk modification and lecithin hydrolysis at levels consistent with good manufacturing practice.
As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate use of the lipase enzyme, as indicated above, while the regulatory process is undertaken to formally amend the Regulations.

Health Canada has received a submission to permit the use of sodium metabisulphite as a colour retention agent and preservative in canned sea snails at levels consistent with good manufacturing practice, provided that residues of this additive in the edible portion of the uncooked product do not exceed 100 parts per million (p.p.m.), calculated as sulphur dioxide. Evaluation of available data supports the safety and effectiveness for this new use of sodium metabisulphite.
Consumers will benefit from the use of this substance in canned sea snails because of the availability of a product that is more tender and visually appealing in colour. It will also benefit industry by facilitating the manufacture of these foods.

St. John's Port Authority — Supplementary letters patent
BY THE MINISTER OF TRANSPORT
WHEREAS Letters Patent were issued by the Minister of Transport for the St. John's Port Authority (the "Authority") under the authority of the Canada Marine Act effective May 1, 1999;
WHEREAS Schedule B of the Letters Patent describes the federal real property managed by the Authority;
WHEREAS the Board of Directors of the Authority has requested the Minister of Transport to issue Supplementary Letters Patent to add to Part I of Schedule B of the Letters Patent the federal real property described below, subject to the activity restrictions specified below;
NOW THEREFORE, under the authority of section 9 of the Canada Marine Act, the Letters Patent are amended by:
(a) adding to Part I of Schedule B of the Letters Patent the federal real property described in Annex A hereto;
(b) adding after section 7.3 of the Letters Patent, the following:
7.4 Restrictions Respecting Federal Real Property. Notwithstanding any other provision of these Letters Patent, the Authority shall comply with the Land Use Restriction Agreement between Her Majesty the Queen in right of Canada and Her Majesty the Queen in right of Newfoundland and Labrador dated January 28, 2005, registered in the Legal Registry of the Department of Transport as Instrument Number 155518, as amended from time to time ("Land Use Restriction Agreement"); and in particular, but without limitation, the Authority shall not undertake any activity described in either Subsection 46(1) of the Act or Article 7.1 of the Letters Patent, and a Subsidiary shall not undertake any activity described in Article 7.3 of the Letters Patent, if the activity results in the federal real property specified immediately below, or any portion thereof, being transferred or used for any purpose other than a corresponding permitted activity or use:
(a) The federal real property described in Schedules A and B of the Land Use Restriction Agreement shall not be used for any purpose other than the permitted uses of automobile storage, for inter-modal operations, or other similar uses, including without limitation, the storage or operation of tractors, trailers and containers and the operation of terminals, assembly yards, maintenance facilities and offices;
(b) The federal real property described in Schedule C of the Land Use Restriction Agreement shall not be used for any purpose other than for activities related to transportation or a port; and
(c) The federal real property described in Schedule D of the Land Use Restriction Agreement shall not be used for any purpose other than:
(i) for activities related to transportation or to a port; or
(ii) the use made of the parcel on January 28, 2005 by the Person (as defined in the Land Use Restriction Agreement) occupying the parcel on that date.
(c) renumbering the current section 7.4 of the Letters Patent as section 7.5.
