Replacement Class Screening Report for Special Events in the Southwest Nova Scotia National Historic Sites of Canada — Public notice

The Canadian Environmental Assessment Agency (the Agency) declares the report entitled Replacement Class Screening Report for Special Events in the Southwest Nova Scotia National Historic Sites of Canada (the RCSR) to be a replacement class screening report pursuant to the provisions of subsection 19(1) and paragraph 19(2)(a) of the Canadian Environmental Assessment Act (the Act).

Public consultations on the RCSR took place from June 30 to July 29, 2005. The Agency received no written submissions from the public concerning the RCSR. In making the declaration proposed by Parks Canada (PC), the Agency has reviewed the RCSR and has determined that the project screening process, as described in the document, will meet the requirements of the Act for the environmental assessment of the class of projects. It is also the opinion of the Agency that the class of projects described in the RCSR is not likely to cause significant adverse environmental effects when the design standards and mitigation measures described in the report are applied.

The declaration is effective October 8, 2005, and is subject to the following terms and conditions:

  • Subject to subsection 19(8) of the Act, the declaration period is valid until July 9, 2009.
  • PC will notify the Agency, in writing, a minimum of six months prior to the date on which the declaration expires, of its intention to renew the RCSR, to renew the RCSR with modifications or additions, or not to renew the RCSR and thereby allow the declaration to expire.
  • To renew the RCSR, PC will submit the proposed class screening report to the Agency not less than three months prior to the expiration date of this declaration so that the Agency may initiate a new declaration process.
  • PC and the Agency will ensure that the RCSR is made available to the public in accordance with the requirements of the Act, as it may be amended from time to time. As such, PC will place the RCSR in the Canadian Environmental Assessment Registry (the CEAR) project file of its Regional Office. PC will also post a statement of the projects in respect of which the RCSR was used on the CEAR Internet site, on a quarterly basis, as required under paragraph 55.1(2)(d) of the Act.
  • Any amendments to the report will be developed and implemented in accordance with the provisions for amendment contained in section 1A of the RCSR.

Erratum — The Commission corrects decision CRTC 2005-419 dated August 18, 2005, in which paragraph 1 is amended and should read as follows:

  1. On October 11, 2004, the Commission received a written complaint concerning a segment of programming broadcast on September 27, 2004, by CFAX, an AM radio station in Victoria, British Columbia. On September 3, 2004, the Commission approved, subject to conditions precedent, an application by CHUM Limited (CHUM) to acquire from Seacoast Communications Group Inc. (Seacoast) the assets of CFAX and CHBE-FM Victoria, and for broadcasting licences to continue the operation of the stations.The conditions precedent were satisfied on September 29, 2004. Seacoast was therefore still the licensee of CFAX at the time of the broadcast in question. In light of the above, the references to "the licensee" in paragraphs 20 and 26 are to Seacoast and all other references to "the licensee," including those in paragraph 27, are to CHUM, the current licensee that replied to the complaint.

The italicized summary at the beginning of the decision is replaced with the following, so that it accurately reflects the body of the decision:

  1. In this decision, the Commission addresses a complaint regarding comments that were broadcast by CFAX, an AM radio station in Victoria. Based on its review of the segment of programming at issue, the Commission finds that, by broadcasting the segment, the licensee of CFAX breached the provision of the Radio Regulations, 1986 that prohibits the broadcast of abusive comment. The Commission requires CHUM Limited, the current licensee of CFAX, to develop guidelines for open-line programming and to submit those guidelines to the Commission within three months of the date of this decision for its approval.

Erratum — The Commission corrects decision CRTC 2005-359 dated July 29, 2005, in which paragraph 10 is amended and should read as follows:

  1. The Commission will issue a Class 1 regional broadcasting licence to operate a cable broadcasting distribution undertaking (BDU) to serve Rimouski, Saint-Georges, Sept-Îles, Baie-Comeau, Gaspé, Montmagny and Sainte-Marie, and their surrounding areas, Quebec. The regulations applicable to Class 1 licensees shall apply to this undertaking, including those relating to distribution on a digital basis. The operation of this undertaking will be regulated in accordance with the Broadcasting Distribution Regulations. The licence will expire August 31, 2011, and will be subject to the conditions set out therein as well as to the conditions set out in the appendix to the decision.
