Letters patent amending the Canadian Coast Guard Exemplary Service Medal Regulations

Her Excellency the Governor General in Council, on the recommendation of the Prime Minister, hereby directs that Letters Patent do issue, under the Great Seal of Canada, amending the Canadian Coast Guard Exemplary Service Medal Regulations, made by Letters Patent on March 28, 1991, in accordance with the annexed schedule.

GREETING:

WHEREAS We did by Our Letters Patent, issued on March 28, 1991, create an award for exemplary service to be designated and styled the Canadian Coast Guard Exemplary Service Medal;

WHEREAS We did by the same Letters Patent direct that the award of the Medal be governed by the Canadian Coast Guard Exemplary Service Medal Regulations, annexed to the Letters Patent;

AND WHEREAS it is desirable and Our Privy Council for Canada has advised that Letters Patent do issue amending the Canadian Coast Guard Exemplary Service Medal Regulations;

NOW KNOW YOU that We, by and with the advice of Our Privy Council for Canada, do by these Presents amend the Canadian Coast Guard Exemplary Service Medal Regulations, in accordance with the annexed schedule.

IN WITNESS WHEREOF, We have caused these Our Letters to be made Patent and the Great Seal of Canada to be hereunto affixed.

WITNESS:

Our Right Trusty and Well-beloved Adrienne Clarkson, Chancellor and Principal Companion of Our Order of Canada, Chancellor and Commander of Our Order of Military Merit, Chancellor and Commander of Our Order of Merit of the Police Forces, Governor General and Commander-in-Chief of Canada.

1. Subsection 9(1) of the Canadian Coast Guard Exemplary Service Medal Regulations is replaced by the following:

9. (1) There is hereby established an Advisory Committee consisting of the Commissioner of the Canadian Coast Guard and four other senior members of the Canadian Coast Guard who shall be appointed by the Commissioner.

Letters patent creating the General Campaign Star and the General Service Medal

Whereas it is desirable and Our Privy Council for Canada has advised that Letters Patent do issue instituting and creating in Canada the General Campaign Star and the General Service Medal for the purpose of according recognition to any person enrolled in, attached to or working with the Canadian Forces who participated in or provided direct support on a full-time basis to operations in the presence of an armed enemy;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Prime Minister, hereby advises Her Majesty the Queen that Letters Patent, to which Her Majesty may be graciously pleased to affix Her signature, do issue under the Great Seal of Canada, providing that there shall be instituted and created in Canada two awards to be designated and styled the General Campaign Star and the General Service Medal, the description and eligibility criteria of which shall be provided for by the General Campaign Star and General Service Medal Regulations annexed to the Letters Patent.

IN WITNESS WHEREOF We have caused these Our Letters to be made Patent and We have caused Our Great Seal of Canada to be affixed to these Presents, which We have signed with Our Royal Hand.

GENERAL CAMPAIGN STAR AND GENERAL
SERVICE MEDAL REGULATIONS

INTERPRETATION

1. The definitions in this section apply in these Regulations.

"Bar" means the bar described in subsection 2(5) or 3(5). (barrette)

"Medal" means the General Service Medal described in section 3. (Médaille)

"Star" means the General Campaign Star described in section 2. (Étoile)

DESCRIPTION

2. (1) The Star shall be 44 mm across and shall consist of a gold-coloured four-point star representing the cardinal points of a compass. It shall have a small ball at the tip of the top point with a ring attached to it through which the ribbon passes.

(2) On the obverse of the Star, being built up in order from the back, shall appear

(a) a wreath of maple leaves terminating at the top with the Royal Crown;

(b) two crossed swords, blades upwards, the blades and hilts forming four additional points to the Star;

(c) a fouled anchor; and

(d) an eagle flying affronty, its head to the sinister, and its wings outstretched extending beyond the wreath.

(3) On the reverse of the Star, within a raised circle, shall appear from top to bottom

(a) the Royal Cypher ensigned by the Royal Crown;

(b) a space for the engraving referred to in subsection (6); and

(c) three maple leaves conjoined on one stem.

(4) The Star shall be suspended from a ribbon, 32 mm in width, consisting of a 12 mm green stripe in the middle, flanked by 2 mm white stripes and 8 mm red stripes.

(5) Each Bar to the Star shall be gold-coloured with raised edges and shall bear the name of the operation or the geographic area for which it is awarded, as specified by the Governor in Council under paragraph 7(b).

(6) The Star shall be engraved on the reverse with the service number, rank, forename initials and surname of the recipient.

3. (1) The Medal shall be 36 mm across and shall consist of a silver-coloured circular medal with a claw at the top attached to a straight slotted bar. The claw shall be in the form of a central maple leaf overlapping two others.

(2) On the obverse of the Medal shall appear the contemporary crowned effigy of Her Majesty the Queen of Canada, facing to the sinister, and circumscribed with the inscriptions "ELIZABETH II DEI GRATIA REGINA" and "CANADA", separated by small crosses pattée.

(3) On the reverse of the Medal, being built up in order from the back, shall appear

(a) two crossed swords, blades upwards,

(b) a fouled anchor, and

(c) an eagle flying affronty, its head to the sinister and wings outstretched.

The whole shall be surmounted by the Royal Crown and surrounded by two branches of maple leaves.

(4) The Medal shall be suspended from a ribbon, 32 mm in width, consisting of an 18 mm red stripe in the middle, flanked by 2 mm white stripes and 5 mm green stripes.

(5) Each Bar to the Medal shall be silver-coloured with raised edges and shall bear the name of the operation or the geographic area for which it is awarded as specified by the Governor in Council under paragraph 7(b).

(6) The Medal shall be engraved on the rim with the service number, rank, forename initials and surname of the recipient.

ELIGIBILITY

4. (1) A member of the Canadian Forces is eligible to be awarded the Star if the member has been posted to, attached to or working with a Canadian or allied unit or formation deployed outside Canada in a theatre of operations, special duty area or special duty operation where the unit or formation was participating in operations in the presence of an armed enemy.

(2) A member of an allied force is eligible to be awarded the Star if the member worked with the Canadian Forces and otherwise meets the criteria applicable to a member of the Canadian Forces set out in subsection (1).

(3) A Canadian citizen other than a member of the Canadian Forces may be awarded the Star by the Governor General on the recommendation of the Chief of the Defence Staff.

5. (1) A member of the Canadian Forces is eligible to be awarded the Medal if the member has been posted to, attached to or working with a Canadian or allied unit or formation deployed outside Canada on a full-time basis in direct support of operations in the presence of an armed enemy but not necessarily in a theatre of operations, special duty area or special duty operation.

(2) A member of an allied force is eligible to be awarded the Medal if the member worked with the Canadian Forces and otherwise meets the criteria applicable to a member of the Canadian Forces set out in subsection (1).

(3) A Canadian citizen other than a member of the Canadian Forces may be eligible to be awarded the Medal if the person worked with a Canadian or allied unit or formation deployed outside Canada either into or outside a theatre of operations, special duty area or special duty operation, on a full-time basis in direct support of operations in the presence of an armed enemy.

6. The Star and the Medal shall only be awarded with a Bar that identifies the specific operation or geographic area in which the recipient served.

7. The Governor in Council shall

(a) determine the conditions that must be satisfied for service that is worthy of recognition by the award of a Bar; and

(b) specify the name of the operation or the geographic area to be inscribed on the Bar.

8. The Star, Medal and Bars shall be awarded for honourable service.

9. Any person who dies or is evacuated because of injuries or medical reasons directly attributable to service is deemed to have satisfied any condition related to a period of service as determined by the Governor in Council under paragraph 7(a).

10. Inspections and visits to conduct administrative activities do not constitute qualifying service.

11. (1) The Star and Medal shall only be awarded to a person once, with qualifying service in respect of additional operations being recognized by the award of additional Bars.

(2) No person shall be awarded a Bar to the Star and a Bar to the Medal in respect of the same operation.

(3) Service counted towards the Star or Medal cannot be counted towards any other Canadian or foreign service medal other than the Canadian Forces' Decoration.

AWARD

12. An award of the Star, the Medal and Bars shall be made

(a) on the recommendation of the Chief of the Defence Staff, who shall make a list of all persons, military and civilian, who are eligible to be awarded the Star, the Medal and Bars and shall forward the list to the Governor General; and

(b) by an instrument signed by the Governor General.

13. The Star, the Medal and the appropriate Bars may be awarded posthumously.

PRESENTATION

14. Unless the Governor General otherwise directs, the Star, the Medal and the Bars shall be presented to a recipient, on behalf of the Governor General, as arranged by the Chief of the Defence Staff.

WEARING OF MEDAL AND BAR

15. (1) The Star shall be worn after the South-West Asia Service Medal on the left breast, suspended from the ribbon described in subsection 2(4) with the Bar centered on the ribbon.

(2) The Medal shall be worn after the Star on the left breast, suspended from the ribbon described in subsection 3(4) with the Bar centered on the ribbon.

(3) Where more than one Bar is worn, they shall be spaced equally on the ribbon and worn in the order earned, the first Bar earned worn closest to the Star or Medal.

(4) When the undress ribbon is worn, a silver maple leaf shall be worn centered on the ribbon of the Star or Medal to indicate the award of a second Bar, a gold maple leaf to indicate the award of a third Bar and a red maple leaf to indicate the award of a fourth or subsequent Bar.

16. A recipient of the Star or Medal may wear a miniature medal, which is one-half the size of the Star or Medal, on all occasions when the wearing of miniature medals is customary.

CANCELLATION AND REINSTATEMENT

17. (1) The Governor General may, on the recommendation of the Chief of the Defence Staff,

(a) cancel or annul the award of the Star, the Medal or a Bar to any person; and

(b) restore the award of a Star, Medal or Bar that has been cancelled or annulled.

(2) Where the award of a Star, Medal or Bar is cancelled or annulled, the name of the recipient shall be deleted from the register referred to in paragraph 18(c).

ADMINISTRATION

18. The Director, Honours, Chancellery shall

(a) acquire the Stars, Medals and Bars;

(b) provide the Stars, Medals and Bars to the Chief of the Defence Staff;

(c) maintain a register containing the names of recipients of the Star, the Medal and the Bars associated with them and such other records relating to the award as the Director considers necessary; and

(d) perform such other functions in respect of awards of the Star, Medal and Bars as the Governor General may require the Director to perform.

GENERAL

19. Nothing in these Regulations limits the right of the Governor General to exercise all powers and authorities of Her Majesty in respect of the Star, Medal and Bars.
