Notice Amending the Canadian Food Inspection Agency Fees Notice
The Minister of Agriculture and Agri-Food, pursuant to subsection 24(1) and section 25 of the Canadian Food Inspection Agency Act, hereby amends the Canadian Food Inspection Agency Fees Notice, published in the Canada Gazette, Part I, on May 13, 2000, in accordance with the annexed notice.

NOTICE AMENDING THE CANADIAN FOOD INSPECTION AGENCY FEES NOTICE
1. The Canadian Food Inspection Agency Fees Notice (see footnote 1) is amended by adding the following after Part 15:

FISH INSPECTION FEES
Interpretation
1. (1) The definitions in this subsection apply in this Part.
"Act" means the Fish Inspection Act. (Loi)
"Regulations" means the Fish Inspection Regulations. (Règlement)
(2) Unless otherwise provided in this Part, other words and expressions have the same meaning as in the Act and the Regulations.
Payment
2. The fees set out in items 1, 2 and 4 of Table 1 shall be paid at the time the application for an import licence or certificate of registration is submitted.
3. The fees set out in items 3, 5, 6 and 7 of Table 1 and Tables 2 and 3 shall be paid on receipt of an invoice from the Agency.

4. (1) Subject to subsection (2), a licensed importer who imports fish into Canada shall pay in respect of the type of product set out in column 1 of an item of table 2, an inspection service fee, per kilogram of declared weight of fish imported, in the amount applicable to the level of licence held by the importer that is set out in column 2, 3 or 4 of that item.

(2) The fee payable for an inspection service is $30 for each shipment of fish if the fish being imported is intended for further processing that will result in a substantial transformation of the fish and the fish is being delivered to a registered establishment.
5. A person who appeals a decision under subsection 10(1) of the Regulations shall pay the applicable fee set out in Table 3 for any type of re-inspection that is ordered under that subsection.

EXPLANATORY NOTE
The publication of the Canadian Food Inspection Agency Fees Notice (the Notice) in May 2000 consolidated the majority of the fee setting authorities for the Canadian Food Inspection Agency under the Canadian Food Inspection Agency Act. Prior to the publication of the Notice, most fees were set by Ministerial order under paragraphs 19(1)(b) and 19.1(b) of the Financial Administration Act. Pursuant to the Fish Inspection Act, the Fish Inspection Regulations (FIR) allow for the prescribing of fees for the registration of establishments, issue of licences and grading and inspection services.
In order to maintain consistency in the Canadian Food Inspection Agency's fee setting authority, the attached amendment adds the majority of the fees payable for services previously found in the FIR to the Notice.
References to fees for non-mandatory fish inspection services (i.e. inspection services provided "on request") will be removed from the FIR and will not be added to the Notice. In order to achieve efficiencies in the administration of the fees charged for these types of services, these fees will be charged under agreements made pursuant to section 14 of the Canadian Food Inspection Agency Act. The fee amounts will remain the same and clients who request these inspection services will not see any appreciable difference in the way these fees are administered.
References to fees in relevant provisions of the FIR will be modified by regulation.

INQUIRY
Industrial Equipment
The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2001-071) from Équipement Industriel Champion Inc., of Québec, Quebec, concerning a procurement (Solicitation No. W0138-016059/A) by the Department of Public Works and Government Services (PWGSC). The requirement is for the supply and installation of a hydraulic lift, parallelogram type. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.
It is alleged that PWGSC improperly awarded the contract to a non-compliant bidder.

The Canadian International Trade Tribunal, under the provisions of subsection 76.03(3) of the Special Import Measures Act, has conducted an expiry review of its finding made on March 21, 1997, in Inquiry No. NQ-96-002, concerning fresh garlic originating in or exported from the People's Republic of China, imported into Canada from July 1 to December 31, inclusive, of each calendar year.

APPLICATION FOR AUTHORIZATION TO EXPORT ELECTRICITY
EPCOR Merchant and Capital Inc.
Notice is hereby given that, by an application dated March 26, 2002, EPCOR Merchant and Capital Inc. (the "Applicant"), on behalf of EPCOR Merchant and Capital L.P., has applied to the National Energy Board (the "Board"), under Division II of Part VI of the National Energy Board Act (the "Act"), for authorization to export, over a ten-year term, up to 4 000 GWh of interruptible energy and up to 3 000 GWh of short-term firm energy in each year of the term. EPCOR Merchant and Capital L.P. carries on energy marketing and energy portfolio management activities. The electricity to be exported will be purchased by the Applicant from Canadian utilities, independent generators and others who have excess electrical power available on a firm or interruptible basis. The electricity to be exported will originate from the provinces of Canada located east of the Alberta-Saskatchewan border.
The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The Directions on Procedure that follow explain in detail the procedure that will be used.
1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at 505 Second Street SW, 8th Floor, Calgary, Alberta T2P 1N8, (403) 717-4600, and provide a copy of the application to any person who requests a copy. A copy of the application is also available for viewing during normal business hours in the Board's library, 444 Seventh Avenue SW, Room 1002, Calgary, Alberta T2P 0X8.
2. Submissions that any party wishes to present shall be filed with the Secretary, National Energy Board, 444 Seventh Avenue SW, Calgary, Alberta T2P 0X8, (403) 292-5503 (Facsimile), and the Applicant by April 29, 2002.
3. Pursuant to subsection 119.06(2) of the Act, the Board shall have regard to all considerations that appear to it to be relevant. In particular, the Board is interested in the views of submittors with respect to :
(a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported;
(b) the impact of the exportation on the environment; and
(c) whether the Applicant has
(i) informed those who have declared an interest in buying electricity
for consumption in Canada of the quantities and classes of service available
for sale, and
(ii) given an opportunity to purchase electricity on terms and conditions
as favorable as the terms and conditions specified in the application
to those who, within a reasonable time of being so informed, demonstrate
an intention to buy electricity for consumption in Canada.
4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this Notice of Application and Directions on Procedure shall be filed with the Secretary of the Board and served on the party that filed the submissions, by May 14, 2002.
5. Any reply that submittors wish to present in response to item 4 of this Notice of Application and Directions on Procedure shall be filed with the Secretary of the Board and served on the Applicant by May 24, 2002.
